Kjo <\/span><a href=\"https:\/\/rm.coe.int\/168046253a\"><span style=\"font-weight: 400;\">p\u00ebrfshin<\/span><\/a><span style=\"font-weight: 400;\"> dhun\u00ebn fizike, seksuale, psikologjike dhe ekonomike, duke p\u00ebrfshir\u00eb k\u00ebrc\u00ebnimet dhe kufizimet e liris\u00eb, si n\u00eb jet\u00ebn publike ashtu edhe n\u00eb at\u00eb private.<\/span><\/p>\n<p><a href=\"https:\/\/rm.coe.int\/168046253a\"><span style=\"font-weight: 400;\">Dhuna n\u00eb familje<\/span><\/a><span style=\"font-weight: 400;\"> p\u00ebrfshin t\u00eb gjitha format e dhun\u00ebs fizike, seksuale, psikologjike ose ekonomike brenda familjes ose marr\u00ebdh\u00ebnies s\u00eb partneritetit. Ligji i ri <\/span><a href=\"https:\/\/www.slvesnik.com.mk\/Issues\/e47c4174574c4dcda6d7e05e713038d6.pdf\"><span style=\"font-weight: 400;\">p\u00ebr parandalimin dhe mbrojtjen nga dhuna ndaj grave dhe dhuna n\u00eb familje<\/span><\/a><span style=\"font-weight: 400;\"> i vitit 2021 zgjeron p\u00ebrkufizimin, duke mbuluar t\u00eb dy format e dhun\u00ebs.<\/span><\/p>\n<p><a href=\"https:\/\/www.stat.gov.mk\/publikacii\/2023\/ZeniteMazite_2023.pdf\"><span style=\"font-weight: 400;\">Statistikat<\/span><\/a><span style=\"font-weight: 400;\"> tregojn\u00eb se burrat jan\u00eb kryesisht autor\u00eb t\u00eb dhun\u00ebs n\u00eb familje \u2013 91% t\u00eb krimeve dhe 84% t\u00eb veprave penale. Viktimat m\u00eb t\u00eb zakonshme jan\u00eb grat\u00eb, ve\u00e7an\u00ebrisht bashk\u00ebshortet. Sipas numrit t\u00eb veprave penale t\u00eb regjistruara n\u00eb lidhje me dhun\u00ebn n\u00eb familje, vepra penale m\u00eb e zakonshme \u00ebsht\u00eb sulmi fizik, e ndjekur nga ngacmimi i tjetrit brenda nj\u00eb apartamenti. N\u00eb vitin 2022, numri i ankesave, kryesisht p\u00ebr abuzim psikologjik, u rrit ndjesh\u00ebm, ku p\u00ebrs\u00ebri shumica e autor\u00ebve ishin burra, dhe shumica e viktimave ishin gra.<\/span><\/p>\n<h1><span style=\"font-weight: 400;\">Kuadri ligjor dhe dokumentet strategjike<\/span><\/h1>\n<p><span style=\"font-weight: 400;\">P\u00ebrpjekjet fillestare p\u00ebr t\u00eb adresuar dhun\u00ebn n\u00eb familje n\u00eb vend filluan n\u00eb vitin 2004, kur dhuna n\u00eb familje u p\u00ebrcaktua p\u00ebr her\u00eb t\u00eb par\u00eb n\u00eb Kodin Penal\u00a0 dhe u krijua nj\u00eb sistem i mbrojtjes penale ligjore. N\u00eb k\u00ebt\u00eb drejtim, <\/span><a href=\"https:\/\/glasprotivnasilstvo.org.mk\/wp-content\/uploads\/Final-draft-NAP-IK-2018-2023.02.pdf\"><span style=\"font-weight: 400;\">Plani i Veprimit p\u00ebr Zbatimin e Konvent\u00ebs p\u00ebr Parandalimin dhe Luftimin e Dhun\u00ebs ndaj Grave dhe Dhun\u00ebs n\u00eb Familje t\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb 2018-2023<\/span><\/a><span style=\"font-weight: 400;\"> u p\u00ebrgatit me tre objektiva: harmonizimi i korniz\u00ebs ligjore me dispozitat e Konvent\u00ebs, krijimi i sh\u00ebrbimeve p\u00ebr mbrojtjen e viktimave t\u00eb dhun\u00ebs me baz\u00eb gjinore dhe viktimave t\u00eb dhun\u00ebs n\u00eb familje dhe zbatimi i aktiviteteve parandaluese. N\u00eb k\u00ebt\u00eb drejtim, plani i veprimit parashikonte nj\u00eb s\u00ebr\u00eb ndryshimesh ligjore ose miratimin e ligjeve t\u00eb reja.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb vitin 2021, u miratua nj\u00eb Ligj i ri <\/span><a href=\"https:\/\/www.slvesnik.com.mk\/Issues\/e47c4174574c4dcda6d7e05e713038d6.pdf\"><span style=\"font-weight: 400;\">p\u00ebr Parandalimin dhe Mbrojtjen nga Dhuna ndaj Grave dhe Dhuna n\u00eb Familje<\/span><\/a><span style=\"font-weight: 400;\">, duke p\u00ebrcaktuar p\u00ebr her\u00eb t\u00eb par\u00eb dhun\u00ebn me baz\u00eb gjinore ndaj grave, p\u00ebrfshir\u00eb vajzat n\u00ebn mosh\u00ebn 18 vje\u00e7, dhe u tejkalua qasja e shtetit p\u00ebr t\u00eb trajtuar dhun\u00ebn n\u00eb familje si nj\u00eb problem neutral gjinor. Ligji mbulon format e reja t\u00eb dhun\u00ebs (p\u00ebrndjekja, gjymtimi gjenital, ngacmimi seksual n\u00eb internet), p\u00ebrfshin grupet e cenueshme (grat\u00eb rome, personat LGBTI, grat\u00eb q\u00eb p\u00ebrdorin drog\u00eb, grat\u00eb shtatz\u00ebna), rregullon trajtimin e institucioneve me kujdesin e duhur, parashikon koordinimin e institucioneve, mbledhjen e t\u00eb dh\u00ebnave dhe riintegrimin e viktimave.\u00a0 Me k\u00ebt\u00eb ligj, viktima ka t\u00eb drejt\u00eb t\u00eb ngrej\u00eb padi n\u00eb nj\u00eb gjykat\u00eb civile p\u00ebr p\u00ebrcaktimin e p\u00ebrgjegj\u00ebsis\u00eb p\u00ebr mosveprim ose munges\u00eb t\u00eb kujdesit t\u00eb duhur ndaj institucioneve dhe personave t\u00eb autorizuar q\u00eb veprojn\u00eb n\u00eb em\u00ebr t\u00eb shtetit. Viktima p\u00ebrjashtohet nga pagesa e t\u00eb gjitha kostove procedurale t\u00eb kompensimit deri n\u00eb p\u00ebrfundimin e mbledhjes s\u00eb pasuris\u00eb dhe zbatimin e k\u00ebrkes\u00ebs ligjore, n\u00eb p\u00ebrputhje me ligjin. P\u00ebr m\u00eb tep\u00ebr, parashikohet q\u00eb viktima q\u00eb nuk mund t\u00eb mbledh\u00eb nga dhunuesi k\u00ebrkes\u00ebn e tij pron\u00ebsore dhe ligjore t\u00eb dh\u00ebn\u00eb me vendim gjyq\u00ebsor t\u00eb form\u00ebs s\u00eb prer\u00eb, do t\u00eb jet\u00eb n\u00eb gjendje t\u00eb k\u00ebrkoj\u00eb pages\u00eb nga nj\u00eb fond shtet\u00ebror.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb shkurt 2023, <\/span><a href=\"https:\/\/ldbis.pravda.gov.mk\/PregledNaZakon.aspx?id=62139\"><span style=\"font-weight: 400;\">u miratuan ndryshime n\u00eb Kodin Penal<\/span><\/a><span style=\"font-weight: 400;\">, t\u00eb cilat p\u00ebrcaktuan dhun\u00ebn me baz\u00eb gjinore p\u00ebr her\u00eb t\u00eb par\u00eb, termin viktim\u00eb e dhun\u00ebs me baz\u00eb gjinore, u prezantua nj\u00eb p\u00ebrkufizim i ri i dhun\u00ebs n\u00eb familje, u prezantuan krime t\u00eb reja (gjymtimi i organeve gjenitale fem\u00ebrore, ndjekja, ngacmimi seksual), nd\u00ebr format kualifikuese t\u00eb kriminel\u00ebve q\u00eb sanksionojn\u00eb dhun\u00ebn n\u00eb familje, p\u00ebrve\u00e7 d\u00ebnimit p\u00ebr dhun\u00ebn n\u00eb familje, u plot\u00ebsua duke sanksionuar format themelore t\u00eb akteve dhe gjat\u00eb kryerjes s\u00eb dhun\u00ebs me baz\u00eb gjinore, u sanksionua vrasja n\u00eb \u00e7ast e kryer gjat\u00eb dhun\u00ebs me baz\u00eb gjinore ndaj grave nga personi i vrar\u00eb. Megjithat\u00eb, <\/span><a href=\"https:\/\/rm.coe.int\/baseline-evaluation-report-on-north-macedonia\/1680ac76ab\"><span style=\"font-weight: 400;\">GREVIO <\/span><\/a><span style=\"font-weight: 400;\">\u00a0v\u00ebren se dhuna psikologjike <\/span><span style=\"font-weight: 400;\">nuk kriminalizohet si nj\u00eb krim i ve\u00e7ant\u00eb, megjith\u00ebse ekzistojn\u00eb disa dispozita t\u00eb Kodit Penal q\u00eb mund t\u00eb mbulojn\u00eb aspekte t\u00eb caktuara t\u00eb k\u00ebsaj forme dhune.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">P\u00ebrve\u00e7 k\u00ebsaj, me kriminalizimin e pamjaftuesh\u00ebm t\u00eb dhun\u00ebs psikologjike dhe faktin q\u00eb ndjekja penale p\u00ebr vepr\u00ebn penale t\u00eb d\u00ebmtimit trupor t\u00eb kryer gjat\u00eb kryerjes s\u00eb dhun\u00ebs me baz\u00eb gjinore, dhun\u00ebs ndaj grave dhe dhun\u00ebs n\u00eb familje ende kryhet me sugjerimin e viktim\u00ebs, efektiviteti i mbrojtjes s\u00eb viktimave d\u00ebmtohet dhe ndjekja objektive e autor\u00ebve t\u00eb krimeve p\u00ebr shkak t\u00eb ndikimit dhe presionit ndaj viktimave zvog\u00eblohet.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb vitin 2022, u miratua <\/span><a href=\"https:\/\/dejure.mk\/zakon\/zakon-za-isplata-na-parichen-nadomestok-na-zhrtvi-od-krivichni-dela-so-nasilstvo\"><span style=\"font-weight: 400;\">Ligji p\u00ebr kompensimin n\u00eb para t\u00eb viktimave t\u00eb krimeve t\u00eb dhunshme<\/span><\/a><span style=\"font-weight: 400;\">, i cili zbatohet nga 25.05.2023, dhe Komisioni p\u00ebr kompensimin n\u00eb para t\u00eb viktimave t\u00eb krimit t\u00eb dhunsh\u00ebm u krijua\u00a0 m\u00eb 13.02.2024. P\u00ebrve\u00e7 k\u00ebsaj, ndihma juridike falas p\u00ebr viktimat vazhdon t\u00eb ofroj\u00eb vet\u00ebm mbrojtje primare, jo sekondare, dhe as nuk jan\u00eb miratuar ndryshimet e shpallura n\u00eb nenin 53 t\u00eb Ligjit p\u00ebr Procedur\u00ebn Penale, i cili do t\u00eb zgjeroj\u00eb mund\u00ebsin\u00eb ligjore t\u00eb kompensimit t\u00eb t\u00eb gjitha viktimave t\u00eb dhun\u00ebs me baz\u00eb gjinore nga fondi shtet\u00ebror, pavar\u00ebsisht nga masa e d\u00ebnimit t\u00eb parashikuar p\u00ebr krimin.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nj\u00eb nga rekomandimet tematike t\u00eb <\/span><a href=\"https:\/\/www.ohchr.org\/en\/hr-bodies\/upr\/guidance\"><span style=\"font-weight: 400;\">Rishikimi Periodik Universal<\/span><\/a><span style=\"font-weight: 400;\"> i ciklit t\u00eb kat\u00ebrt \u2013 sesioni 46 p\u00ebr vendin ton\u00eb n\u00eb lidhje me dhun\u00ebn me baz\u00eb gjinore duke p\u00ebrfshir\u00eb dhun\u00ebn me baz\u00eb gjinore ndaj grave, \u00ebsht\u00eb finalizimi dhe miratimi i ligjit p\u00ebr barazin\u00eb gjinore dhe ngritjen e kapaciteteve t\u00eb institucioneve shtet\u00ebrore p\u00ebr t&#8217;iu p\u00ebrgjigjur dhun\u00ebs me baz\u00eb gjinore. Megjith\u00ebse projektligji p\u00ebr Barazin\u00eb Gjinore ishte <\/span><a href=\"https:\/\/ener.gov.mk\/Default.aspx?item=pub_regulation&amp;subitem=view_reg_detail&amp;itemid=75591\"><span style=\"font-weight: 400;\">i botuar n\u00eb ENER<\/span><\/a><span style=\"font-weight: 400;\"> n\u00eb vitin 2022, ky ligj ende nuk \u00ebsht\u00eb miratuar. As nuk jan\u00eb miratuar ndryshime n\u00eb Ligjin p\u00ebr Mbrojtjen Sociale, i cili do t\u00eb harmonizohet me dispozitat e Ligjit p\u00ebr Parandalimin dhe Mbrojtjen nga Dhuna ndaj Grave dhe Dhun\u00ebs n\u00eb Familje t\u00eb vitit 2021.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00cbsht\u00eb thelb\u00ebsore q\u00eb shteti t\u00eb ket\u00eb nj\u00eb pasqyr\u00eb t\u00eb rasteve t\u00eb dhun\u00ebs me baz\u00eb gjinore ndaj grave, prandaj nevojiten <\/span><a href=\"https:\/\/mtsp.gov.mk\/pocetna-ns_article-nacionalniot-plan-za-sproveduvanje-na-konvencijata-za-sprecuvanje-i-borba-protiv-nasilstvoto-vrz-zen.nspx\"><span style=\"font-weight: 400;\">amendamente <\/span><span style=\"font-weight: 400;\">dhe<\/span><span style=\"font-weight: 400;\"> plot\u00ebsim i Rregullave t\u00eb Gjykat\u00ebs<\/span><\/a><span style=\"font-weight: 400;\"> n\u00eb p\u00ebrputhje me t\u00eb cilat do t\u00eb p\u00ebrfshihen kategori t\u00eb ve\u00e7anta p\u00ebr regjistrimin e rasteve t\u00eb dhun\u00ebs n\u00eb familje dhe dhun\u00ebs me baz\u00eb gjinore n\u00eb procedurat civile dhe penale.\u00a0<\/span><\/p>\n<h1><span style=\"font-weight: 400;\">Aplikimi n\u00eb praktik\u00eb\u00a0<\/span><\/h1>\n<p><a href=\"https:\/\/dzr.mk\/mk\/250821-nedovolna-efikasnost-na-sistemot-za-zashtita-na-zhenite-zhrtvi-na-nasilstvo\"><span style=\"font-weight: 400;\">Auditimi i Zyr\u00ebs Shtet\u00ebrore t\u00eb Auditimit (21 gusht 2025)<\/span><\/a><span style=\"font-weight: 400;\"> konstatoi se institucionet nuk ofrojn\u00eb mb\u00ebshtetje, mbrojtje dhe riintegrim adekuat dhe efektiv t\u00eb viktimave t\u00eb dhun\u00ebs me baz\u00eb gjinore dhe dhun\u00ebs n\u00eb familje. Nga 52 aktivitetet e <\/span><a href=\"https:\/\/glasprotivnasilstvo.org.mk\/wp-content\/uploads\/Final-draft-NAP-IK-2018-2023.02.pdf\"><span style=\"font-weight: 400;\">\u00a0Planit t\u00eb Veprimit p\u00ebr Zbatimin e Konvent\u00ebs p\u00ebr Parandalimin dhe Luftimin e Dhun\u00ebs ndaj Grave dhe Dhun\u00ebs n\u00eb Familje p\u00ebr periudh\u00ebn (2018\u20132023),<\/span><\/a><span style=\"font-weight: 400;\"> zbatohen plot\u00ebsisht 22, pjes\u00ebrisht 10, dhe 20 aspak. Nevojiten gjithashtu 19 qendra k\u00ebshillimi, nd\u00ebrkaq q\u00eb jan\u00eb krijuar 11 (59%). N\u00eb disa rajone, nuk ka fare strehimore ose ambiente k\u00ebshillimi. P\u00ebr m\u00eb tep\u00ebr, nuk ka sistem t\u00eb licencimit t\u00eb rregullt p\u00ebr sh\u00ebrbimet e specializuara dhe linjat SOS.<\/span><\/p>\n<p><a href=\"https:\/\/epi.org.mk\/en\/post\/31866\"><span style=\"font-weight: 400;\">T\u00eb dh\u00ebnat nga Ministria e Brendshme<\/span><\/a><span style=\"font-weight: 400;\"> tregojn\u00eb se n\u00eb gjysm\u00ebn e par\u00eb t\u00eb vitit 2024 jan\u00eb raportuar 528 akte t\u00eb dhun\u00ebs n\u00eb familje dhe me baz\u00eb gjinore, nga t\u00eb cilat 84% ishin gra. M\u00eb t\u00eb zakonshmet jan\u00eb l\u00ebndimet trupore dhe rrezikimi i siguris\u00eb, nd\u00ebrkaq jan\u00eb regjistruar edhe raste t\u00eb l\u00ebndimeve t\u00eb r\u00ebnda, vrasjeve dhe tentim-vrasjeve. Prokurorit\u00eb publike n\u00eb vitin 2024 mor\u00ebn 323 kall\u00ebzime, kryesisht direkt nga viktimat. Nj\u00eb num\u00ebr i vog\u00ebl viktimash b\u00ebn\u00eb deklarata para <\/span><a href=\"https:\/\/epi.org.mk\/en\/post\/31866\"><span style=\"font-weight: 400;\">prokuroris\u00eb<\/span><\/a><span style=\"font-weight: 400;\">, nj\u00eb num\u00ebr edhe m\u00eb i vog\u00ebl me avokat, megjith\u00ebse ligj\u00ebrisht ekziston nj\u00eb e drejt\u00eb e kufizuar p\u00ebr ndihm\u00eb juridike falas.
