Kjo u b\u00eb e ditur n\u00eb kuad\u00ebr t\u00eb masave p\u00ebr integrimin gradual t\u00eb vendeve kandidate. P\u00ebr vitin e ardhsh\u00ebm paralajm\u00ebrohet p\u00ebrfshirje e vendeve t\u00eb tjera kandidate.<\/p>\n<p>Ky raport vjetor e vler\u00ebson gjendjen e sundimit t\u00eb ligjit n\u00eb t\u00eb gjitha shtetet an\u00ebtare t\u00eb BE-s\u00eb dhe synon t\u2019i mb\u00ebshtes\u00eb vendet kandidate n\u00eb p\u00ebrpjekjet e tyre p\u00ebr reforma. Ndryshe nga instrumentet e tjera t\u00eb sundimit t\u00eb ligjit \u2013 procedura e shkeljes dhe neni 7 i TEU-s\u00eb p\u00ebr pezullim, ky instrument kryesisht p\u00ebrdor dialogun si metod\u00eb dhe synon ngritjen e kultur\u00ebs p\u00ebr sundimin e ligjit n\u00eb shtetet an\u00ebtare p\u00ebrmes nd\u00ebrgjegj\u00ebsimit.<\/p>\n<p>Jo rast\u00ebsisht me Raportin publikohen edhe rezultatet e <a href=\"https:\/\/europa.eu\/eurobarometer\/surveys\/detail\/3224\">Eurobarometrit special p\u00ebr sundimin e ligjit<\/a>. Ky hulumtimi i opinionit publik n\u00eb BE, i cili fatkeq\u00ebsisht nuk p\u00ebrfshin vendet kandidate, tregon se qytetar\u00ebt e saj \u00e7mojn\u00eb shum\u00eb vlerat thelb\u00ebsore t\u00eb BE-s\u00eb &#8211; 89% thon\u00eb se \u00ebsht\u00eb e r\u00ebnd\u00ebsishme p\u00ebr ta q\u00eb t\u00eb gjitha vendet an\u00ebtare t\u00eb BE-s\u00eb t\u00eb respektojn\u00eb vlerat thelb\u00ebsore t\u00eb BE-s\u00eb, duke p\u00ebrfshir\u00eb t\u00eb drejtat themelore, sundimin e ligjit dhe demokracin\u00eb. E r\u00ebnd\u00ebsishme \u00ebsht\u00eb q\u00eb 72% e evropian\u00ebve besojn\u00eb se BE-ja luan nj\u00eb rol t\u00eb r\u00ebnd\u00ebsish\u00ebm n\u00eb ruajtjen sundimit t\u00eb ligjit n\u00eb vendin e tyre.<\/p>\n<p>Sundimi i ligjit \u00ebsht\u00eb p\u00ebrcaktuar si thelb\u00ebsor p\u00ebr vlerat demokratike, t\u00eb drejtat individuale dhe zhvillimin social dhe ekonomik, ve\u00e7an\u00ebrisht n\u00eb kontekstin e sfidave t\u00eb ndryshme sociale si dhe tensionet gjeopolitike<\/p>\n<p>Ashtu si n\u00eb vitet e m\u00ebparshme, raporti fokusohet n\u00eb kat\u00ebr shtylla kryesore:<\/p>\n<ol>\n<li>Sistemet gjyq\u00ebsore<\/li>\n<li>Kornizat kund\u00ebr korrupsionit<\/li>\n<li>Liria dhe pluralizmi i mediave<\/li>\n<li>\u00c7\u00ebshtjet lidhur me kontrollin dhe balancin institucional.<\/li>\n<\/ol>\n<p>Sipas fjal\u00ebve t\u00eb n\u00ebnkryetares s\u00eb KE-s\u00eb, Vera Jurova, p\u00ebr vlerat dhe transparenc\u00ebn ka progres, por ka edhe stagnim, madje edhe regres n\u00eb disa vende dhe n\u00eb disa fusha.<\/p>\n<p>Ka dallime t\u00eb m\u00ebdha nd\u00ebrmjet shteteve an\u00ebtare, n\u00ebse gjykohet nga niveli i zbatimit t\u00eb rekomandimeve t\u00eb vitit t\u00eb kaluar, q\u00eb \u00ebsht\u00eb duksh\u00ebm kriteri m\u00eb i matsh\u00ebm. Komisioni Evropian thekson se 68% e rekomandimeve nga viti 2023 jan\u00eb zbatuar (65% vitin e kaluar). Megjithat\u00eb, kjo p\u00ebrqindje jep nj\u00eb pasqyr\u00eb mjaft pozitive, duke pasur parasysh se Komisioni i konsideron t\u00eb gjitha notat p\u00ebrve\u00e7 &#8220;pa p\u00ebrparim&#8221; dhe &#8220;pa p\u00ebrparim t\u00eb m\u00ebtejsh\u00ebm&#8221; si veprime. Vler\u00ebsime t\u00eb tilla jan\u00eb: &#8220;p\u00ebrparim i caktuar&#8221;, &#8220;p\u00ebrparim&#8221;, &#8220;p\u00ebrparim i caktuar i m\u00ebtejsh\u00ebm&#8221;, &#8220;p\u00ebrparim i konsideruesh\u00ebm&#8221; dhe &#8220;plot\u00ebsisht e realizuar&#8221;.<\/p>\n<p>P\u00ebr dallim nga shtetet an\u00ebtare, p\u00ebr vendet kandidate nuk jan\u00eb dh\u00ebn\u00eb rekomandime, q\u00eb do t\u00eb thot\u00eb se vitin e ardhsh\u00ebm as nuk do t\u00eb mund t\u00eb jepet vler\u00ebsim p\u00ebr zbatimin e tyre. Kjo redukton ndjesh\u00ebm krahasueshm\u00ebrin\u00eb me shtetet an\u00ebtare, por gjithashtu tregon hap\u00ebsir\u00eb \u200b\u200bp\u00ebr p\u00ebrmir\u00ebsim n\u00eb &#8220;integrimin gradual&#8221;.<\/p>\n<h2>Nota p\u00ebr Maqedonin\u00eb e Veriut<\/h2>\n<p>P\u00ebr autoritetet maqedonase, por edhe m\u00eb gj\u00ebr\u00eb, p\u00ebr t\u00eb gjitha subjektet relevante, \u00ebsht\u00eb jasht\u00ebzakonisht e r\u00ebnd\u00ebsishme t\u00eb njohin mesazhet e k\u00ebtij <a href=\"chrome-extension:\/\/efaidnbmnnnibpcajpcglclefindmkaj\/https:\/commission.europa.eu\/document\/download\/e7197a43-7f00-4eac-b02d-818ac71345f0_en?filename=61_1_58090_coun_chap_northmacedonia_nm.pdf\">Raporti<\/a>, i cili publikohet vet\u00ebm tre muaj para raportit t\u00eb rregullt vjetor p\u00ebr vendin dhe menj\u00ebher\u00eb pas zgjedhjes s\u00eb Qeveris\u00eb s\u00eb re. Edhe pse rezultate t\u00eb m\u00ebdha nuk jan\u00eb t\u00eb mundshme, \u00ebsht\u00eb shum\u00eb e r\u00ebnd\u00ebsishme se n\u00eb cilin drejtim do t\u00eb zhvillohen aktivitetet, si dhe cil\u00ebsia e dialogut &#8211; t\u00eb brendsh\u00ebm dhe me BE-n\u00eb.<\/p>\n<p>N\u00eb k\u00ebt\u00eb analiz\u00eb fillestare, ne p\u00ebrqendrohemi n\u00eb disa pika kryesore, kryesisht n\u00eb elementet m\u00eb t\u00eb theksuara dhe m\u00eb t\u00eb reja n\u00eb k\u00ebt\u00eb raport n\u00eb lidhje me Raportin Vjetor t\u00eb N\u00ebntorit 2023.<\/p>\n<p>Raporti ofron nj\u00eb s\u00ebr\u00eb argumentesh dhe d\u00ebshmish n\u00eb mb\u00ebshtetje t\u00eb vler\u00ebsimit se \u201cpavar\u00ebsia e <strong>gjyq\u00ebsorit<\/strong> dhe kapacitetet institucionale mbeten \u00e7\u00ebshtje shqet\u00ebsimi\u201d. Raporti thekson masat e marra n\u00eb lidhje me situatat shqet\u00ebsuese t\u00eb vler\u00ebsuara m\u00eb par\u00eb t\u00eb K\u00ebshillit gjyq\u00ebsor. Paralajm\u00ebrimi kryesor ka t\u00eb b\u00ebj\u00eb me &#8220;shp\u00ebrb\u00ebrjen&#8221; e K\u00ebshillit gjyq\u00ebsor dhe K\u00ebshillit t\u00eb prokuror\u00ebve publik t\u00eb shpallur nga Qeveria e re: (me t\u00eb drejt\u00eb) shkakton &#8220;shqet\u00ebsim serioz&#8221; pasiq\u00eb do t\u00eb cenonte pavar\u00ebsin\u00eb e gjyq\u00ebsorit.<\/p>\n<p>Ndryshe, n\u00eb an\u00ebn pozitive jan\u00eb miratimi i Strategjis\u00eb Zhvillimore Sektoriale p\u00ebr Gjyq\u00ebsorin dhe Planit t\u00eb Veprimit, themelimi i K\u00ebshillit p\u00ebr Reforma, Planit t\u00eb Veprimit p\u00ebr zbatimin e rekomandimeve t\u00eb Misionit t\u00eb TAIEKS p\u00ebr K\u00ebshillin gjyq\u00ebsor, si dhe masat p\u00ebr p\u00ebrmir\u00ebsimin e transparenc\u00ebs t\u00eb marra nga kryetar\u00ebt e Gjykat\u00ebs s\u00eb lart\u00eb dhe t\u00eb K\u00ebshillit gjyq\u00ebsor.<\/p>\n<p>Shqet\u00ebsuese \u00ebsht\u00eb edhe tendenca e theksuar e uljes s\u00eb efikasitetit t\u00eb gjyq\u00ebsorit \u2013 gj\u00eb q\u00eb ka qen\u00eb pika e fort\u00eb e tij vitet e fundit. \u00cbsht\u00eb e qart\u00eb se mungesa kronike e burimeve financiare dhe njer\u00ebzore po e b\u00ebn t\u00eb vet\u00ebn.<\/p>\n<p>Ka nj\u00eb vones\u00eb t\u00eb konsiderueshme n\u00eb zbatimin e Strategjis\u00eb Komb\u00ebtare p\u00ebr <strong>luft\u00ebn kund\u00ebr korrupsionit<\/strong>, nd\u00ebrsa ve\u00e7an\u00ebrisht kritik \u00ebsht\u00eb rishikimi i ndryshimeve t\u00eb vitit t\u00eb kaluar n\u00eb Kodin penal. P\u00ebr faktin se rreziqet e larta t\u00eb korrupsionit vazhdojn\u00eb, ve\u00e7an\u00ebrisht n\u00eb sektorin e prokurimit publik dhe pun\u00ebsimeve n\u00eb sektorin publik. N\u00eb raport thuhet se: \u201cMungon nj\u00eb qasje sistematike n\u00eb trajtimin e korrupsionit p\u00ebr t\u00eb adresuar em\u00ebruesit e p\u00ebrbashk\u00ebt t\u00eb faktor\u00ebve t\u00eb rrezikut\u201d. Fatkeq\u00ebsisht, nuk mund t\u00eb identifikojm\u00eb sinjale t\u00eb reja q\u00eb do t\u00eb \u00e7onin n\u00eb zgjidhjen e &#8220;em\u00ebruesve t\u00eb p\u00ebrbashk\u00ebt&#8221;, t\u00eb identifikuar tashm\u00eb n\u00eb Skrining Raportin, si p\u00ebr shembull &#8220;ndikimi i fort\u00eb politik n\u00eb sektorin publik; shkalla e ul\u00ebt e sanksionimit t\u00eb sjelljeve korruptive; rregulloret jokonsistente; niveli i ul\u00ebt i zbatimit t\u00eb masave t\u00eb integritetit; transparenca; sistemi mbik\u00ebqyr\u00ebs dhe mekanizma kontrolli t\u00eb pamjaftuesh\u00ebm n\u00eb sektorin publik\u201d.<\/p>\n<p>P\u00ebrs\u00ebriten sfidat n\u00eb lidhje me transparenc\u00ebn e pron\u00ebsis\u00eb s\u00eb <strong>media<\/strong><strong>ve<\/strong>. Raporti shpreh shqet\u00ebsim p\u00ebr rikthimin e reklamave mediatike t\u00eb financuara nga shteti, duke p\u00ebrmendur paralajm\u00ebrimet nga entitetet komb\u00ebtare p\u00ebr p\u00ebr\u00e7arje t\u00eb mundshme t\u00eb pluralizmit mediatik, si dhe keqp\u00ebrdorim politik t\u00eb financimit. Gjithashtu, megjith\u00ebse jan\u00eb forcuar garancionet ligjore p\u00ebr mbrojtjen e gazetar\u00ebve, jan\u00eb regjistruar k\u00ebrc\u00ebnime dhe raste t\u00eb dhun\u00ebs verbale dhe fizike ndaj gazetar\u00ebve dhe punonj\u00ebsve n\u00eb media.<\/p>\n<p>P\u00ebr sa i p\u00ebrket sistemit t\u00eb <strong>kontrolleve dhe balancave<\/strong>, duhet marr\u00eb seriozisht kritikat e qarta p\u00ebr p\u00ebrdorimin e procedurave t\u00eb shkurta, si dhe p\u00ebr cil\u00ebsin\u00eb e ul\u00ebt t\u00eb sistemit t\u00eb politik\u00ebb\u00ebrjes, i cili duhet t\u00eb jet\u00eb gjith\u00ebp\u00ebrfshir\u00ebs dhe i bazuar n\u00eb d\u00ebshmi. Organizatat civile punojn\u00eb n\u00eb nj\u00eb mjedis p\u00ebrgjith\u00ebsisht favorizues, por konstatimet negative lidhur me zbatimin e Strategjis\u00eb dhe Planit t\u00eb Veprimit vazhdojn\u00eb, si mosfunksionimi i K\u00ebshillit p\u00ebr bashk\u00ebpunim me organizatat civile. Nj\u00eb nga treguesit n\u00eb Raport \u00ebsht\u00eb numri dhe veprimi n\u00eb baz\u00eb t\u00eb t\u00eb ashtuquajturve \u201cgjykime udh\u00ebheq\u00ebse\u201d t\u00eb Gjykat\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut, t\u00eb cilat u rrit\u00ebn n\u00eb 17 gjykime m\u00eb 1 korrik t\u00eb k\u00ebtij viti. Mungesa e burimeve dhe mosveprimi sipas rekomandimeve t\u00eb Avokatit t\u00eb Popullit jan\u00eb gjithashtu objekt i kritikave.<\/p>\n<p>Sfidat kryesore p\u00ebr qeverin\u00eb e re jan\u00eb m\u00ebnyra se si do t&#8217;i p\u00ebrgjigjet trendet negative dhe si do t\u00eb reagoj\u00eb ndaj &#8220;shqet\u00ebsimeve serioze&#8221;. Nga ajo pritet t\u00eb vazhdoj\u00eb, gjegj\u00ebsisht t\u00eb avancoj\u00eb dhe inkurajoj\u00eb trendet pozitive dhe t\u00eb nd\u00ebrmer masa t\u00eb mir\u00ebmenduara dhe efikase p\u00ebr t\u00eb ndalur trendet negative. Dhe, sigurisht \u2013 p\u00ebr ta b\u00ebr\u00eb k\u00ebt\u00eb p\u00ebrmes nj\u00eb procesi t\u00eb dialogut, t\u00eb bazuar n\u00eb argumente.<\/p>\n<p>Didier Rejnders, Komisioneri p\u00ebr Drejt\u00ebsi, n\u00eb prezantimin e Raportit tha se pes\u00eb vitet e Raportit t\u00eb BE-s\u00eb kan\u00eb treguar se dialogu mund t\u00eb ndihmoj\u00eb p\u00ebr t\u00eb arritur p\u00ebrparim t\u00eb r\u00ebnd\u00ebsish\u00ebm.
