Kjo pik\u00eb nuk t\u00ebrhoqi shum\u00eb v\u00ebmendje, mbase sepse nuk \u00ebsht\u00eb as fillimi, por dhe as fundi i pun\u00ebs. M\u00eb shum\u00eb mund t\u00eb thuhet se \u00ebsht\u00eb diku n\u00eb mes. Paketa p\u00ebr transparenc\u00ebn dhe marketingun politik \u00ebsht\u00eb pjes\u00eb e zbatimit t\u00eb Planit Evropian t\u00eb Veprimit p\u00ebr Demokraci t\u00eb propozuar n\u00eb n\u00ebntor t\u00eb vitit 2021. Propozimi kryesor \u00ebsht\u00eb Rregullorja e re p\u00ebr transparenc\u00ebn dhe targetimin n\u00eb marketingun politik. Krahas k\u00ebsaj\u00a0<strong>propozohen edhe tekste t\u00eb reja t\u00eb rregullores p\u00ebr partit\u00eb politike evropiane<\/strong>, si dhe direktivat p\u00ebr t\u00eb drejtat e votuesve mobil p\u00ebr zgjedhjet n\u00eb Parlamentin Evropian dhe zgjedhjet komunale n\u00eb shtetet an\u00ebtare.<\/p>\n<p>Motivi kryesor i cili nxiti harmonizimin e ligjit n\u00eb k\u00ebt\u00eb fush\u00eb n\u00eb BE ishte teknika e zhvilluar p\u00ebr targetimin e votuesve nga Kembrixh Analitika (nd\u00ebr t\u00eb tjera e p\u00ebrdorur edhe n\u00eb fushat\u00ebn presidenciale t\u00eb Trump-it dhe n\u00eb referendumin p\u00ebr Brexit-in). Me pak fjal\u00eb,\u00a0<strong>targetimi \u00ebsht\u00eb nj\u00eb teknik\u00eb t\u00eb cil\u00ebn e p\u00ebrdor sponsori i reklamave p\u00ebr t\u00eb p\u00ebrcaktuar personat tek t\u00eb cil\u00ebt d\u00ebshiron t\u00eb arrij\u00eb<\/strong>\u00a0\u2013 n\u00eb var\u00ebsi t\u00eb p\u00ebrmbajtjes s\u00eb faqes s\u00eb internetit t\u00eb cil\u00ebn qytetari e shfleton ose n\u00eb var\u00ebsi t\u00eb karakteristikave t\u00eb tij\/saj personale. P\u00ebrdorimi dhe p\u00ebrpunimi i nj\u00eb sasie t\u00eb madhe t\u00eb t\u00eb dh\u00ebnave personale n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb paraqet nj\u00eb rrezik t\u00eb madh p\u00ebr manipulimin e proceseve zgjedhore dhe n\u00eb p\u00ebrgjith\u00ebsi edhe t\u00eb hap\u00ebsir\u00ebs publike.<\/p>\n<p>Rregullorja e propozuar i referohet transparenc\u00ebs dhe marketingut politik, duke p\u00ebrfshir\u00eb k\u00ebtu edhe targetimin. Ajo nuk synon harmonizimin e kushteve dhe k\u00ebrkesave t\u00eb tjera thelb\u00ebsore t\u00eb procesit zgjedhor, t\u00eb cilat jan\u00eb ekskluzivisht n\u00ebn kompetenc\u00eb t\u00eb shteteve an\u00ebtare.<\/p>\n<p>Rregullat komb\u00ebtare ekzistuese jan\u00eb shum\u00eb t\u00eb fragmentuara. T\u00eb gjith\u00eb an\u00ebtar\u00ebt kan\u00eb nj\u00ebfar\u00eb rregullash, por q\u00eb jan\u00eb shum\u00eb t\u00eb ndryshme sa i p\u00ebrket marketingut politik, madje kan\u00eb edhe p\u00ebrkufizime t\u00eb ndryshme. Sa i p\u00ebrket hap\u00ebsir\u00ebs online,\u00a0<strong>vet\u00ebm 17 vende an\u00ebtare kan\u00eb rregulla dhe vet\u00ebm 3 prej tyre kan\u00eb rregulla t\u00eb ve\u00e7anta p\u00ebr marketingun politik online<\/strong>. Intervenimi i BE-s\u00eb shpjegohet me gjendjen e fragmentimit t\u00eb tregut t\u00eb brendsh\u00ebm, sigurin\u00eb e zvog\u00ebluar ligjore p\u00ebr ofruesit e sh\u00ebrbimeve t\u00eb marketingut politik, barrierat ekzistuese p\u00ebr l\u00ebvizjen e lir\u00eb t\u00eb sh\u00ebrbimeve t\u00eb ngjashme dhe konkurrenc\u00ebn e \u00e7rregulluar n\u00eb tregun e brendsh\u00ebm. Nga ana tjet\u00ebr, vler\u00ebsohet se masat aktuale t\u00eb vet\u00ebrregullimit n\u00eb nivel t\u00eb BE-s\u00eb nuk po i japin rezultatet e nevojshme.<\/p>\n<p>BE-ja fillimisht e trajton k\u00ebt\u00eb fush\u00eb nga aspekti i liris\u00eb s\u00eb ofrimit t\u00eb sh\u00ebrbimeve, por edhe nga aspekti i mbrojtjes t\u00eb t\u00eb dh\u00ebnave personale. Natyrisht, implikime ka edhe ndaj t\u00eb drejtave themelore.<\/p>\n<p>Rregullorja parashikon nj\u00eb s\u00ebr\u00eb detyrimesh p\u00ebr transparenc\u00eb t\u00eb ofruesve t\u00eb sh\u00ebrbimeve t\u00eb marketingut.<strong>\u00a0\u00c7do reklam\u00eb politike do t\u00eb duhet t\u00eb identifikohet qart\u00eb si e till\u00eb dhe duhet t\u00eb sh\u00ebnohet sponsori<\/strong>, por edhe t\u00eb p\u00ebrmbaj\u00eb ose ta b\u00ebj\u00eb leht\u00ebsisht t\u00eb qasshme t\u00eb ashtuquajtur\u00ebn shpallje p\u00ebr transparenc\u00eb, e cila duhet t\u00eb siguroj\u00eb nj\u00eb kuptim t\u00eb kontekstit m\u00eb t\u00eb gjer\u00eb dhe q\u00ebllimit t\u00eb reklam\u00ebs. Nd\u00ebr t\u00eb tjera, ajo do t\u00eb duhet t\u00eb ket\u00eb informacion p\u00ebr kontakt me sponsorin, periudh\u00ebn e reklamimit, si dhe p\u00ebr fondet e shpenzuara.<\/p>\n<p>Rregullorja e propozuar i tangon ofruesit e sh\u00ebrbimeve t\u00eb marketingut, si dhe subjektet politike \u2013 partit\u00eb politike, kandidat\u00ebt, fondacionet, por edhe organizatat civile q\u00eb p\u00ebrdorin reklama. \u00cbsht\u00eb pik\u00ebrisht kjo e fundit ajo q\u00eb shkakton dilema\u00a0<strong>p\u00ebr shkak t\u00eb rrezikut t\u00eb kufizimit t\u00eb reklamimit t\u00eb organizatave t\u00eb shoq\u00ebris\u00eb civile<\/strong>\u00a0p\u00ebr avokimin e q\u00ebllimeve legjitime t\u00eb politikave me interes publik, por edhe nevoj\u00ebs p\u00ebr t\u00eb parandaluar abuzimin e organizatave joqeveritare nga subjektet politike.<\/p>\n<p><strong>Ky propozim parasheh q\u00eb zbatimi t\u00eb b\u00ebhet n\u00eb nivel komb\u00ebtar.<\/strong>\u00a0Disa kritik\u00eb e parashtrojn\u00eb pyetjen e efikasitetit t\u00eb k\u00ebsaj qasjeje, ve\u00e7an\u00ebrisht sepse, edhe pse parashihet detyrimi p\u00ebr shtetet an\u00ebtare p\u00ebr t\u00eb parashikuar sanksione, nuk p\u00ebrcaktohet nj\u00eb sanksion minimal.<\/p>\n<p>Kritikat m\u00eb t\u00eb m\u00ebdha p\u00ebr k\u00ebt\u00eb propozim kan\u00eb t\u00eb b\u00ebjn\u00eb me targetimin. Edhe\u00a0<strong>propozimi origjinal i Komisionit u vler\u00ebsua si nga mjaft i moderuar deri n\u00eb joefektiv<\/strong>. P\u00ebr shembull, mendimi i Mbik\u00ebqyr\u00ebsit Evropian p\u00ebr mbrojtjen e t\u00eb dh\u00ebnave \u00ebsht\u00eb se propozimi aktual nuk ofron m\u00eb shum\u00eb mbrojtje sesa legjislacioni ekzistues p\u00ebr mbrojtjen e t\u00eb dh\u00ebnave, duke u zotuar p\u00ebr nj\u00eb ndalim gjith\u00ebp\u00ebrfshir\u00ebs t\u00eb mikro-targetimit. T\u00eb fuqish\u00ebm jan\u00eb edhe z\u00ebrat p\u00ebr nj\u00eb ndalim gjith\u00ebp\u00ebrfshir\u00ebs t\u00eb mikro-targetimit n\u00eb Parlamentin Evropian.\u00a0<strong>Diskutimi pritet t\u00eb intensifikohet me kalimin e propozim-rregullores n\u00eb faz\u00ebn e bisedimeve<\/strong>\u00a0mes K\u00ebshillit dhe Parlamentit Evropian.
