Jan\u00eb pjes\u00eb t\u00eb konkluzioneve t\u00eb propozuara nga K\u00ebshilli i BE-s\u00eb p\u00ebr \u00c7\u00ebshtje t\u00eb P\u00ebrgjithshme p\u00ebr Maqedonin\u00eb, t\u00eb cilat duhet t\u00eb jen\u00eb n\u00eb tryez\u00ebn e K\u00ebshillit p\u00ebr \u00c7\u00ebshtje t\u00eb P\u00ebrgjithshme m\u00eb 23 qershor dhe drafti i ri i korniz\u00ebs negociuese t\u00eb paraqitur nga Presidenca franceze.<\/p>\n<p>Konkluzionet e propozuara t\u00eb K\u00ebshillit sigurojn\u00eb dy pika hyr\u00ebse p\u00ebr zbatim t\u00eb plot\u00eb t\u00eb k\u00ebrkesave bullgare: 1. zbatimi i Marr\u00ebveshjes dypal\u00ebshe p\u00ebr Miq\u00ebsi dhe Bashk\u00ebpunim me Bullgarin\u00eb si nj\u00eb nga kushtet themelore n\u00eb negociata dhe 2. p\u00ebrfshirja e bullgar\u00ebve n\u00eb Kushtetut\u00ebn e Maqedonis\u00eb, s\u00eb bashku me ve\u00e7imin e t\u00eb drejtave t\u00eb pakicave si pjes\u00eb e kritereve t\u00eb Kopenhag\u00ebs. P\u00ebr marr\u00ebveshjen dypal\u00ebshe \u00ebsht\u00eb parapar\u00eb nj\u00eb protokoll i ve\u00e7ant\u00eb, i cili duksh\u00ebm \u00ebsht\u00eb ende i paqart\u00eb, sepse n\u00eb disa vende tekstet jan\u00eb \u00a0n\u00eb kllapa.<\/p>\n<p>N\u00eb tekstin e konkluzioneve t\u00eb propozuara thuhet se \u201ckonferenca nd\u00ebrqeveritare e radh\u00ebs p\u00ebr hapjen e negociatave\u201d do t\u00eb mbahet pasi Maqedonia e Veriut t\u2019i p\u00ebrfshij\u00eb bullgar\u00ebt n\u00eb preambul\u00ebn e Kushtetut\u00ebs \u2013 obligim t\u00eb cilin qeveria jon\u00eb tashm\u00eb e ka nd\u00ebrmarr\u00eb. Prandaj, \u00e7do g\u00ebzim p\u00ebr largimin e vetos dhe v\u00ebnien n\u00eb dukje t\u00eb \u201chapjes p\u00ebrfundimtare t\u00eb negociatave\u201d duket i tep\u00ebrt. Hapja e negociatave n\u00eb rastin ton\u00eb padyshim do t\u00eb jet\u00eb nj\u00eb proces q\u00eb do t\u00eb zgjas\u00eb m\u00eb shum\u00eb.<\/p>\n<p>T\u00eb p\u00ebrkujtojm\u00eb se Konferenca e Par\u00eb Nd\u00ebrqeveritare (e parapar\u00eb p\u00ebr 23 qershor, n\u00ebse propozimi kalon) \u00ebsht\u00eb vet\u00ebm nj\u00eb prezantim i Q\u00ebndrimit t\u00eb P\u00ebrgjithsh\u00ebm t\u00eb K\u00ebshillit, i cili p\u00ebrb\u00ebhet nga nj\u00eb Deklarat\u00eb Hyr\u00ebse dhe nj\u00eb Korniz\u00eb Negociatore.<\/p>\n<p>N\u00eb k\u00ebto tekste ka disa ndryshime t\u00eb r\u00ebnd\u00ebsishme krahasuar me propozimin e m\u00ebparsh\u00ebm nga fundi i presidenc\u00ebs gjermane. Ato kryesisht kan\u00eb t\u00eb b\u00ebjn\u00eb me: zbatimin e Marr\u00ebveshjes p\u00ebr Miq\u00ebsi dhe Bashk\u00ebpunim me Bullgarin\u00eb (dhe at\u00eb t\u00eb Presp\u00ebs), gjuh\u00ebn maqedonase, t\u00eb drejtat e \u201cpakicave apo komuniteteve\u201d, si dhe m\u00ebnyr\u00ebn e monitorimit.<\/p>\n<p>Kuadri negociator, krahas kritereve t\u00eb Kopenhag\u00ebs dhe kritereve t\u00eb Procesit p\u00ebr Stabilizim Asociim, e ngre k\u00ebrkes\u00ebn p\u00ebr zbatimin e Marr\u00ebveshjes s\u00eb Presp\u00ebs dhe p\u00ebr Miq\u00ebsi me Bullgarin\u00eb dhe t\u00eb protokolleve p\u00ebr zbatimin e saj n\u00eb nj\u00eb nivel t\u00eb ri, duke k\u00ebrkuar \u201crezultate t\u00eb dukshme\u201d dhe \u201czbatim t\u00eb vullnetit t\u00eb mir\u00eb\u201d.<\/p>\n<p>Ndon\u00ebse n\u00eb tekstin e vjet\u00ebr t\u00eb Korniz\u00ebs Negociatore q\u00ebndron se\u00a0<em>acquis<\/em>\u00a0do t\u00eb p\u00ebrkthehet n\u00eb maqedonisht, n\u00eb deklarat\u00ebn hyr\u00ebse BE-ja deklaron se Bullgaria dhe Maqedonia e Veriut synojn\u00eb t\u00eb l\u00ebshojn\u00eb deklarata t\u00eb nj\u00ebanshme p\u00ebr gjuh\u00ebn maqedonase. Nuk mund t\u00eb presim q\u00eb Bullgaria t\u00eb ndryshoj\u00eb q\u00ebndrimin e saj n\u00eb lidhje me gjuh\u00ebn maqedonase, nuk e dim\u00eb tekstin e deklarat\u00ebs son\u00eb, as nuk kemi garanci se k\u00ebto deklarata nuk do t\u00eb ndikojn\u00eb n\u00eb trajtimin e m\u00ebtejsh\u00ebm t\u00eb gjuh\u00ebs n\u00eb BE (n\u00eb t\u00eb kund\u00ebrt\u00ebn, do t\u2019i bashk\u00ebngjitet Procesverbalit t\u00eb Konferenc\u00ebs s\u00eb Par\u00eb Nd\u00ebrqeveritare). Ndaj, pohimet n\u00eb stilin \u201cgjuha\/identiteti jan\u00eb mbrojtur\u201d duken naive.<\/p>\n<p>Ndryshimet m\u00eb t\u00eb m\u00ebdha jan\u00eb b\u00ebr\u00eb sa i p\u00ebrket t\u00eb drejtave t\u00eb pakicave apo komuniteteve. \u00cbsht\u00eb prezantuar nj\u00eb plan i ve\u00e7ant\u00eb veprimi p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb personave q\u00eb u p\u00ebrkasin pakicave ose komuniteteve, i cili i shtohet Udh\u00ebzimeve p\u00ebr Sundimin e Ligjit (Kapitujt 23 dhe 24). N\u00eb k\u00ebto fusha, n\u00eb k\u00ebt\u00eb plan, qart\u00eb dallohen k\u00ebrkesat bullgare: mos diskriminimi, lufta kund\u00ebr gjuh\u00ebs s\u00eb urrejtjes, madje edhe fusha e arsimit q\u00eb nuk i p\u00ebrket formalisht k\u00ebtyre kapitujve. Me k\u00ebt\u00eb plan k\u00ebrkohet t\u00eb ket\u00eb \u201cmasa efektive, mekanizma raportues dhe p\u00ebrcaktim t\u00eb institucioneve kompetente\u201d \u2013 p\u00ebrs\u00ebri k\u00ebrkesa t\u00eb njohura bullgare, madje p\u00ebr k\u00ebt\u00eb do t\u00eb ket\u00eb nj\u00eb raport t\u00eb ve\u00e7ant\u00eb nga Komisioni. Nuk ka pasur kurr\u00eb nj\u00eb kombinim kaq t\u00eb \u00e7uditsh\u00ebm t\u00eb fushave p\u00ebr asnj\u00eb vend, thjesht sepse \u00ebsht\u00eb prer\u00eb \u201csipas mas\u00ebs bullgare\u201d.<\/p>\n<p>Nuk mund t\u00eb na g\u00ebzoj\u00eb fakti se zbatimi i Marr\u00ebveshjes p\u00ebr Miq\u00ebsi dhe Fqinj\u00ebsi me Bullgarin\u00eb nuk ka hyr\u00eb si kapitull m\u00eb vete, sepse p\u00ebrfshirja e k\u00ebrkesave bullgare n\u00eb klasterin Themelet (q\u00eb ishte k\u00ebrkes\u00eb e ndryshuar bullgare) ka, n\u00eb mos pesh\u00eb m\u00eb t\u00eb madhe, at\u00ebher\u00eb t\u00eb pakt\u00ebn t\u00eb nj\u00ebjt\u00ebn si nj\u00eb kapitull i ve\u00e7ant\u00eb. Klasteri Themelet do t\u00eb hapet i pari dhe do t\u00eb mbyllet i fundit. Progresi n\u00eb k\u00ebt\u00eb klaster e p\u00ebrcakton ecurin\u00eb e negociatave n\u00eb p\u00ebrgjith\u00ebsi. Udh\u00ebzimet p\u00ebr hapjen e Klasterit jan\u00eb Udh\u00ebrr\u00ebfyesi p\u00ebr Sundimin e Ligjit (Kapitujt 23 dhe 24), si dhe administrata publike q\u00eb autoritetet e Maqedonis\u00eb duhet t\u00eb p\u00ebrgatisin, por pas propozimit francez \u2013 dhe Planit t\u00eb veprimit p\u00ebr pakicat\/komunitetet. K\u00ebto standarde, me propozimin e Komisionit Evropian, miratohen nj\u00ebz\u00ebri nga K\u00ebshilli, i cili, kur vendos n\u00ebse ato jan\u00eb p\u00ebrmbushur, vendos standarde t\u00eb p\u00ebrkohshme. Nuk mund t\u00eb mbyllet asnj\u00eb kapitull derisa K\u00ebshilli i BE-s\u00eb t\u00eb konkludon se standardet e p\u00ebrkohshme jan\u00eb p\u00ebrmbushur.<\/p>\n<p>SA p\u00ebr krahasim: Mali i Zi dhe Serbia si pik\u00eb referimi p\u00ebr hapjen e kapitujve t\u00eb sundimit t\u00eb ligjit (at\u00ebher\u00eb nuk kishte klaster\u00eb) kishin nj\u00eb plan veprimi \u2013 at\u00eb p\u00ebr Kapitujt 23 dhe 24. N\u00eb propozimin francez p\u00ebr ne ka tre \u2013 p\u00ebr sundimin e ligjit, administrat\u00ebn planin e veprimit p\u00ebr pakicat\/komunitetet. \u00a0Asnj\u00eb kapitull nuk mund t\u00eb mbyllet derisa K\u00ebshilli i BE-s\u00eb t\u00eb arrij\u00eb n\u00eb p\u00ebrfundimin se standardet e p\u00ebrkohshme jan\u00eb p\u00ebrmbushur dhe p\u00ebr planin e veprimit p\u00ebr pakicat\/komunitetet, nd\u00ebrsa mund t\u00eb shtohen standarde t\u00eb tjer\u00eb p\u00ebr kapituj dhe fusha t\u00eb tjera t\u00eb grupit Themelet. Mali i Zi kishte gjithsej 82 standarde t\u00eb p\u00ebrkohshme, Serbia \u2013 91. Ata jan\u00eb duke negociuar tashm\u00eb dhjet\u00eb vjet, kurse standardet e p\u00ebrkohshme jan\u00eb vendosur nj\u00eb vit e gjysm\u00eb pas fillimit t\u00eb negociatave p\u00ebr Malin e Zi (n\u00eb 2013), si dhe dy vjet e gjysm\u00eb pas fillimit p\u00ebr Serbin\u00eb (2016). P\u00ebrve\u00e7 k\u00ebsaj, planet n\u00eb Serbi-Malin e Zi tashm\u00eb kan\u00eb p\u00ebsuar disa rishikime, dhe raportet p\u00ebr to jan\u00eb tem\u00eb e debateve serioze n\u00eb t\u00eb dy shtetet.<\/p>\n<p>Sikurse n\u00eb rastin me Serbin\u00eb dhe Malin e Zi, Komisioni Evropian do t\u2019i raportoj\u00eb K\u00ebshillit t\u00eb BE-s\u00eb p\u00ebr p\u00ebrmbushjen e standardeve t\u00eb p\u00ebrkohshme t\u00eb sundimit t\u00eb ligjit \u00e7do gjasht\u00eb muaj, vet\u00ebm n\u00eb rastin ton\u00eb do t\u00eb jen\u00eb dy udh\u00ebrr\u00ebfyes dhe nj\u00eb plan veprimi. Gjithashtu p\u00ebr Maqedonin\u00eb, Komisioni do t\u2019i dor\u00ebzoj\u00eb K\u00ebshillit raporte t\u00eb rregullta p\u00ebr p\u00ebrmbushjen e kushtit p\u00ebr marr\u00ebdh\u00ebnie t\u00eb mira fqinj\u00ebsore, gjegj\u00ebsisht zbatimin e Marr\u00ebveshjes s\u00eb Presp\u00ebs dhe Marr\u00ebveshjes p\u00ebr Bullgarin\u00eb, p\u00ebrfshir\u00eb protokollet e panjohura deri m\u00eb tani.<\/p>\n<p>Mbi t\u00eb gjitha, sipas Metodologjis\u00eb s\u00eb re, do t\u00eb zbatohet rregulli i kthimit t\u00eb procesit (revirzibilitetit) \u2013 n\u00ebse vler\u00ebsohet se n\u00eb ndonj\u00eb fush\u00eb t\u00eb caktuar ka regres, hapja e klasterit mund t\u00eb \u201ckthehet mbrapa\u201d, sipas nj\u00eb procedure t\u00eb ve\u00e7ant\u00eb.<\/p>\n<p>N\u00ebse pranohet propozimi francez, Bullgaria do t\u00eb ket\u00eb baz\u00eb ligjore p\u00ebr t\u00eb b\u00ebr\u00eb v\u00ebrejtje dhe sugjerime jo vet\u00ebm p\u00ebr udh\u00ebrr\u00ebfyesit, por edhe p\u00ebr Planin e Veprimit t\u00eb bashkangjitur p\u00ebr pakicat\/komunitetet, kurse natyrisht edhe p\u00ebr standardet e p\u00ebrkohshme. Do t\u00eb ket\u00eb shum\u00eb mund\u00ebsi p\u00ebr veto. Nuk \u00ebsht\u00eb e v\u00ebshtir\u00eb t\u00eb supozohet se n\u00eb tavolin\u00eb mund t\u00eb vihet gjith\u00e7ka \u2013 duhet vet\u00ebm t\u00eb shikohen deklaratat e zyrtar\u00ebve bullgar\u00eb, t\u00eb qeverive t\u00eb ndryshme n\u00eb periudh\u00ebn e kaluar, dhe mund t\u2019i presim \u201crisit\u00eb\u201d e tyre n\u00eb t\u00eb ardhmen. E nj\u00ebjta gj\u00eb vlen edhe p\u00ebr kontributin e mundsh\u00ebm t\u00eb Bullgaris\u00eb n\u00eb diskutimin e raporteve q\u00eb do t\u00eb dor\u00ebzohen nga Komisioni dhe n\u00eb form\u00ebsimin e konkluzioneve t\u00eb K\u00ebshillit t\u00eb BE-s\u00eb p\u00ebr to.<\/p>\n<p>Prandaj, \u00ebsht\u00eb e v\u00ebshtir\u00eb t\u00eb flitet p\u00ebr \u201cmbyllje\u201d t\u00eb \u00e7\u00ebshtjeve me Bullgarin\u00eb. P\u00ebrkundrazi, ne marrim detyrime t\u00eb reja, pakrahasueshme m\u00eb t\u00eb m\u00ebdha dhe t\u00eb ndryshme nga vendet e tjera aderuese, jasht\u00eb\u00a0<em>acquis<\/em>\u00a0s\u00eb BE-s\u00eb. Cili do t\u00eb jet\u00eb ndikimi n\u00eb planin e brendsh\u00ebm \u00ebsht\u00eb \u00e7\u00ebshtje e ve\u00e7ant\u00eb q\u00eb duhet t\u00eb shtjellohet ve\u00e7mas. Megjithat\u00eb, duke ditur se \u00e7far\u00eb ndarjesh, n\u00eb t\u00eb gjitha linjat, shkaktuan Marr\u00ebveshja e Presp\u00ebs dhe m\u00eb pas k\u00ebrkesat e Bullgaris\u00eb, mund t\u00eb supozojm\u00eb se cili do t\u00eb jet\u00eb ndikimi kur k\u00ebto \u00e7\u00ebshtje si pjesa m\u00eb e r\u00ebnd\u00ebsishme e agjend\u00ebs s\u00eb an\u00ebtar\u00ebsimit n\u00eb BE t\u00eb ngrihen vazhdimisht si prioritet n\u00eb shoq\u00ebrin\u00eb maqedonase n\u00eb dekad\u00ebn e ardhshme ose dekadat n\u00eb vijim.<\/p>\n<p>N\u00eb fund t\u00eb presidenc\u00ebs s\u00eb saj gjasht\u00ebmujore t\u00eb BE-s\u00eb, Franca do t\u00eb jet\u00eb n\u00eb gjendje t\u00eb mburret se i ka dh\u00ebn\u00eb Ukrain\u00ebs kandidatur\u00ebn e saj dhe se nuk e ka harruar Ballkanin Per\u00ebndimor, por se ka b\u00ebr\u00eb p\u00ebrparim vendimtar hequr veton ndaj Maqedonis\u00eb s\u00eb Veriut dhe Shqip\u00ebris\u00eb.
