Sipas nj\u00eb hulumtimi, 60 p\u00ebrqind nga t\u00eb anketuarit kan\u00eb deklaruar se u jan\u00eb k\u00ebrkuar \u201cinformacione shtes\u00eb\u201d p\u00ebr k\u00ebrkesat, di\u00e7ka q\u00eb nuk \u00ebsht\u00eb e p\u00ebrshkruar me ligjin e tanish\u00ebm.<\/strong><\/p>\n<p>Reforma e administrat\u00ebs publike n\u00eb Maqedoni \u00ebsht\u00eb nj\u00eb nga fushat baz\u00eb ku \u00ebsht\u00eb i nevojsh\u00ebm reformimi i vendit n\u00eb rrug\u00ebn drejt\u00eb an\u00ebtar\u00ebsimit n\u00eb Unionit Evropian. Pa marr\u00eb parasysh se vendi, bashk\u00eb me vendet tjera t\u00eb Ballkanit Per\u00ebndimor, i zbaton k\u00ebto reforma tanim\u00eb nj\u00eb dekad\u00eb, qysh n\u00eb vitin 2014, Komisioni Evropian jep nj\u00eb set t\u00eb parimeve p\u00ebr vendet kandidate p\u00ebr an\u00ebtar\u00ebsim t\u00eb cilat duhet ta ndjekin dhe tu p\u00ebrmbahen atyre, p\u00ebr tu b\u00ebr\u00eb vende t\u00eb suksesshme an\u00ebtare t\u00eb UE.<\/p>\n<h5><strong>Llogaridh\u00ebnie e institucioneve<\/strong><\/h5>\n<p>\u00c7ka n\u00ebnkuptoni me llogaridh\u00ebnie t\u00eb institucioneve? P\u00ebrse k\u00ebrkojm\u00eb q\u00eb ato t\u00eb jen\u00eb t\u00eb hapura p\u00ebrkat\u00ebsisht transparente n\u00eb pun\u00ebn e vet? A ekziston korrelacion midis transparenc\u00ebs dhe dyshimeve p\u00ebr veprime korruptuese t\u00eb atyre q\u00eb financohet nga parat\u00eb tona? \u00a0T\u00eb gjitha k\u00ebto pyetje mund t\u00eb na \u00e7ojn\u00eb t\u00eb mendojm\u00eb \u00e7ka do t\u00eb thot\u00eb ajo kur dikush nuk \u00ebsht\u00eb transparent n\u00eb pun\u00ebn\u00a0 e vet (e me k\u00ebt\u00eb rast ky informacion t\u00eb mos jet\u00eb i sh\u00ebnuar si sekret shtet\u00ebror) dhe a do t\u00eb thot\u00eb kjo se di\u00e7ka \u00ebsht\u00eb duke u fshehur, gj\u00eb e cila m\u00eb tej sjell n\u00eb dyshimin se a ekziston ndonj\u00eb far\u00eb kriminaliteti ose keqp\u00ebrdorim t\u00eb pozit\u00ebs zyrtare ose keqp\u00ebrdorim t\u00eb financave.<\/p>\n<p>Gjegj\u00ebsisht, pas themelimit t\u00eb Qeveris\u00eb m\u00eb 1 qershor t\u00eb vitit 2017, nj\u00eb nga angazhimet e saj t\u00eb para ishte avancimi i transparenc\u00ebs dhe t\u00eb llogaridh\u00ebnies t\u00eb pun\u00ebs s\u00eb administrat\u00ebs publike p\u00ebrkat\u00ebsisht\u00a0<a href=\"https:\/\/vlada.mk\/sites\/default\/files\/programa\/2017-2020\/Programa_Vlada_2017-2020_MKD.pdf\" target=\"_blank\" rel=\"noopener\">krijimi i administrat\u00ebs profesionale dhe efikase<\/a>, llogaridh\u00ebn\u00ebse dhe transparente e cila do t\u00eb siguroj\u00eb sh\u00ebrbime cil\u00ebsore p\u00ebr qytetar\u00ebt dhe sektorin e biznesit dhe do ti mbroj\u00eb t\u00eb drejtat e tyre. Mandej, m\u00eb 27 n\u00ebntor t\u00eb vitit 2017, Qeveria\u00a0<a href=\"https:\/\/vlada.mk\/node\/13781\" target=\"_blank\" rel=\"noopener\">publikoi kumtes\u00eb<\/a>\u00a0me list\u00eb t\u00eb dokumenteve t\u00eb cilat institucionet qeveritare duhet ti publikojn\u00eb n\u00eb pajtim me Ligjin p\u00ebr qasje t\u00eb lir\u00eb n\u00eb informacionet me karakter publik. Aty jan\u00eb p\u00ebrfshir\u00eb\u00a0<a href=\"https:\/\/vlada.mk\/InformaciiJavenKarakter\" target=\"_blank\" rel=\"noopener\">21 dokument<\/a>\u00a0q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me transparenc\u00ebn e institucioneve dhe e paraqesin \u201clet\u00ebr njoftimin\u201d e tyre, nd\u00ebrsa disa prej tyre kan\u00eb t\u00eb b\u00ebjn\u00eb me buxhetet, raportet revizore, listat e t\u00eb pun\u00ebsuarve, rregulloren e vendeve t\u00eb pun\u00ebs e k\u00ebshtu me radh\u00eb. Me k\u00ebt\u00eb rast, pa marr\u00eb parasysh se nuk ka p\u00ebrparim t\u00eb ve\u00e7ant\u00eb n\u00eb pik\u00ebpamje\u00a0 t\u00eb publikimit t\u00eb analizave t\u00eb politikave, publikimeve dhe m\u00ebnyr\u00ebn e prezantimit t\u00eb vet\u00eb dokumenteve, shumica e institucioneve, n\u00eb at\u00eb periudh\u00eb prap\u00ebseprap\u00eb filluan ti publikojn\u00eb k\u00ebto\u00a0<a href=\"https:\/\/vlada.mk\/InformaciiJavenKarakter\" target=\"_blank\" rel=\"noopener\">informacione me karakter publik<\/a>t\u00eb p\u00ebrcaktuara n\u00eb kumtes\u00ebn.<\/p>\n<p>P\u00ebr fat t\u00eb keq, kjo nuk u shnd\u00ebrrua n\u00eb praktik\u00eb, p\u00ebrkat\u00ebsisht nj\u00eblloj si edhe t\u00eb gjitha reformat e paralajm\u00ebruara filluan me dinamik\u00eb t\u00eb fuqishme nd\u00ebrsa tani kan\u00eb ngecur, k\u00ebshtu q\u00eb edhe kjo reform\u00eb filloi mir\u00eb, por aktualisht \u00ebsht\u00eb n\u00eb ngecje e sip\u00ebr. Llogaridh\u00ebnia dhe transparenca n\u00eb t\u00eb cil\u00ebn shihet p\u00ebrmes llojit t\u00eb till\u00eb t\u00eb dokumenteve tani zhvillohet ad-hok, p\u00ebrkat\u00ebsisht shum\u00eb nga k\u00ebto dokumente s\u00ebrish (p\u00ebr shembull, Ministria e drejt\u00ebsis\u00eb n\u00eb ueb faqen e vet, ende nuk i ka bashk\u00ebngjitur t\u00eb gjitha k\u00ebto dokumente t\u00eb obligueshme) duhet t\u00eb k\u00ebrkohen nga institucionet n\u00eb vend q\u00eb t\u00eb publikohen n\u00eb m\u00ebnyr\u00eb proaktive. N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, kontaktet relevante p\u00ebr bashk\u00ebpunim me organizatat civile ende nuk jan\u00eb t\u00eb dukshme, nd\u00ebrsa publikimi i informacioneve p\u00ebr proceset e konsultimeve publike tanim\u00eb jan\u00eb p\u00ebrjashtim se sa praktik\u00eb.<\/p>\n<h5><strong>Konteksti institucional<\/strong><\/h5>\n<p>N\u00eb k\u00ebt\u00eb kontekst me r\u00ebnd\u00ebsi \u00ebsht\u00eb t\u00eb p\u00ebrmendet e drejta p\u00ebr k\u00ebrkim t\u00eb qasjes s\u00eb lir\u00eb ne informacionet me karakter publik. Pa marr\u00eb parasysh se ekziston Komision p\u00ebr mbrojtje t\u00eb t\u00eb drejt\u00ebs p\u00ebr qasje t\u00eb lir\u00eb n\u00eb informacionet me karakter publik, ajo p\u00ebr momentin \u00ebsht\u00eb jofunksionale dhe punon me personel t\u00eb zvog\u00ebluar. Gjithashtu, Komisioni ka mekaniz\u00ebm t\u00eb dob\u00ebt t\u00eb ekzekutimit \u2013 nuk mund tu urdh\u00ebroj\u00eb institucioneve q\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrpikt\u00eb ta zbatojn\u00eb ligjin dhe paraqet mang\u00ebsi n\u00eb kuad\u00ebr t\u00eb pun\u00ebs s\u00eb saj.<\/p>\n<p>Prap\u00ebseprap\u00eb, sipas\u00a0<a href=\"https:\/\/ener.gov.mk\/default.aspx?item=pub_regulation&amp;subitem=view_reg_detail&amp;itemid=+M\/3VwBwjciqlxNlMns48w==\" target=\"_blank\" rel=\"noopener\">informacioneve<\/a>, t\u00eb fundit ky problem tanim\u00eb \u00ebsht\u00eb i tejkaluar me Propozim \u2013 ligjin e ri p\u00ebr qasje t\u00eb lir\u00eb n\u00eb informacionet me karakter publik, ku parashihet q\u00eb t\u00eb\u00a0<strong>\u201cudh\u00ebhiqet procedur\u00eb administrative dhe t\u00eb vendoset p\u00ebr ankesat kund\u00ebr vendimit me t\u00eb cilin poseduesi i informacionit e ka refuzuar k\u00ebrkes\u00ebn p\u00ebr qasje n\u00eb informacionet nga k\u00ebrkuesit\u201d<\/strong>. N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, p\u00ebr shkak t\u00eb k\u00ebtyre ndryshimeve dhe kompetencave t\u00eb zgjeruara, Komisioni do t\u00eb shlyhet t\u00ebr\u00ebsisht dhe do t\u00eb z\u00ebvend\u00ebsohet me Agjenci p\u00ebr mbrojtje t\u00eb t\u00eb drejt\u00ebs p\u00ebr qasje t\u00eb lir\u00eb n\u00eb informacionet me karakter publik. Si hap\u00ebrim m\u00eb qen\u00ebsor p\u00ebrpara duhet t\u00eb konsiderohet edhe \u00a0kompetenca e re e cila paraprakisht mungonte, e ajo \u00ebsht\u00eb se Agjencia do t\u00eb mund t\u00eb \u201crealizoj\u00eb procedur\u00eb penale p\u00ebrmes\u00a0<a href=\"https:\/\/prizma.mk\/finansiite-na-partiite-ke-stanat-javen-podatok\/?fbclid=IwAR1dnNgAi_vOdayxg248-bvSOinx2Zi4fHcvs4xt0t3JtL3U-2C2oiVOYCQ\" target=\"_blank\" rel=\"noopener\">komisionit p\u00ebr kund\u00ebrvajtje<\/a>\u00a0i cili vendos p\u00ebr kund\u00ebrvajtje n\u00eb pajtim me ligjin\u201d.<\/p>\n<p>Krahas Komisionit jofunksional, problem paraqet edhe afati i gjat\u00eb p\u00ebr d\u00ebrgim t\u00eb informacioneve t\u00eb k\u00ebrkuara (30 dit\u00eb), por edhe ai gjithmon\u00eb nuk respektohet dhe shpesh her\u00eb informacionet e dh\u00ebna mund\u00a0 t\u00eb jen\u00eb jo t\u00eb plota, p\u00ebrkat\u00ebsisht ta shmangin pyetjen e parashtruar nga k\u00ebrkuesit e informacioneve. N\u00eb raport me m\u00ebnyr\u00ebn n\u00eb t\u00eb cil\u00ebn Komisioni ka vepruar gjat\u00eb viteve t\u00eb kaluara p\u00ebr ankesat e k\u00ebrkuesve, mund t\u00eb thuhet se n\u00eb pjes\u00ebn m\u00eb t\u00eb madhe ka vendosur n\u00eb dobi t\u00eb tyre.<\/p>\n<p>Nga kjo rezulton se edhepse afati \u00ebsht\u00eb i gjat\u00eb, gj\u00eb e cila n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb nuk do t\u00eb thot\u00eb se poseduesit e informacioneve duhet t\u00eb presin q\u00eb t\u00eb kalojn\u00eb ato 30 dit\u00eb, por thjesht\u00eb t\u00eb ken\u00eb koh\u00eb t\u00eb mjaftueshme p\u00ebr grumbullimin e informacioneve t\u00eb k\u00ebrkuara, afati vetvetiu nuk paraqet problem\u00a0 sa q\u00eb ekziston munges\u00eb e d\u00ebshir\u00ebs s\u00eb poseduesve t\u00eb informacioneve q\u00eb ti d\u00ebrgojn\u00eb k\u00ebto informacione.<\/p>\n<p>N\u00eb nj\u00eb\u00a0<a href=\"https:\/\/weber-cep.s3.amazonaws.com\/data\/attachment_701\/western_balkan_par_monitor_2017-2018.pdf\" target=\"_blank\" rel=\"noopener\">hulumtim<\/a>\u00a0t\u00eb realizuar t\u00eb paradokohsh\u00ebm, t\u00eb realizuar n\u00eb kuad\u00ebr t\u00eb projektit\u00a0<a href=\"http:\/\/www.par-monitor.org\/\" target=\"_blank\" rel=\"noopener\">WeBER<\/a>\u00a0p\u00ebrmes \u201cRrjetit Mendo p\u00ebr Evrop\u00eb (<a href=\"https:\/\/ten.europeanpolicy.org\/\" target=\"_blank\" rel=\"noopener\">TEN<\/a>)\u201c, ku \u00ebsht\u00eb zbatuar anketa p\u00ebr mendimin e p\u00ebrfaq\u00ebsuesve t\u00eb organizatave civile, t\u00eb cilat n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb jan\u00eb ata q\u00eb shpesh e shfryt\u00ebzojn\u00eb k\u00ebt\u00eb t\u00eb drejt\u00eb, nga hulumtimi mund t\u00eb konkludohet se institucionet u qasen k\u00ebrkesave me dyshim t\u00eb caktuar. P\u00ebr shembull, 60 p\u00ebrqind nga t\u00eb anketuarit nga organizatat civile, deklaruan se u jan\u00eb k\u00ebrkuar \u201csqarime shtes\u00eb\u201d p\u00ebr k\u00ebrkesat, di\u00e7ka q\u00eb nuk \u00ebsht\u00eb e p\u00ebrshkruar me ligjin e tanish\u00ebm.<\/p>\n<p>Nga t\u00ebr\u00eb ajo q\u00eb \u00ebsht\u00eb th\u00ebn\u00eb deri tani, nuk duhet t\u00eb kuptohet se publikimi i dokumenteve relevante dhe informimi p\u00ebrkat\u00ebs i qytetar\u00ebve p\u00ebr k\u00ebrkesat e tyre jan\u00eb ndonj\u00eb far\u00eb procesi i mundimsh\u00ebm ose \u201crevolucionar\u201d, por nevoj\u00eb e cila \u00ebsht\u00eb e duhur q\u00eb vazhdimisht t\u00eb zhvillohet. K\u00ebto reforma nuk duhet t\u00eb kuptohen si di\u00e7ka q\u00eb duhet t\u00eb b\u00ebhet s\u00ebrish; thjesht\u00eb duhet t\u00eb fillohet me implementim t\u00eb prioriteteve strategjike t\u00eb cilat kan\u00eb t\u00eb b\u00ebjn\u00eb me llogaridh\u00ebnien dhe transparenc\u00ebn n\u00eb \u00e7do institucion. K\u00ebt\u00eb proces duhet ta kuptojn\u00eb edhe t\u00eb pun\u00ebsuarit n\u00eb institucionet shtet\u00ebrore, t\u00eb cil\u00ebt gjithashtu jan\u00eb qytetar\u00eb t\u00eb cil\u00ebt n\u00eb fund t\u00eb dit\u00ebs do t\u00eb duhet ta presin n\u00eb raport me llogaridh\u00ebnien dhe dh\u00ebnien e sh\u00ebrbimeve nga k\u00ebto institucione.<\/p>\n<p>N\u00eb realitet, ky proces i reformave t\u00eb vazhdueshme ndodh edhe n\u00eb vendet t\u00eb cilat kan\u00eb kultur\u00eb t\u00eb zhvilluar t\u00eb pun\u00ebs administrative, si p\u00ebr shembull sistemi administrativ n\u00eb Britani t\u00eb Madhe, ku llogaridh\u00ebnia dhe transparenca jan\u00eb t\u00eb vendosura n\u00eb nivel t\u00eb lart\u00eb, ku t\u00eb gjitha institucionet qeveritare dhe agjencit\u00eb, dokumentet e tyre dhe sh\u00ebrbimet elektronike t\u00eb cilat ofrohen, mund t\u00eb gjenden n\u00eb\u00a0<a href=\"https:\/\/www.gov.uk\/\" target=\"_blank\" rel=\"noopener\">nj\u00eb vend<\/a>. Nuk do t\u00eb thot\u00eb se reformat b\u00ebhen kur do t\u00eb konstatohet ndonj\u00eb far\u00eb problemi, por ajo \u00ebsht\u00eb p\u00ebrshtatje e aparatit administrativ ndaj nevojave t\u00eb qytetar\u00ebve, me \u00e7\u2019rast procesi reformues duhet t\u00eb zhvillohet n\u00eb m\u00ebnyr\u00eb t\u00eb vazhdueshme.
