Korrupsioni perceptohet kryesisht si nj\u00eb problem ekonomik ose politik, i cili g\u00ebrryen institucionet, g\u00ebrryen moralin publik dhe minon etik\u00ebn profesionale. Por pas \u00e7do rasti korrupsioni \u00ebsht\u00eb nj\u00eb shkelje e s\u00eb drejt\u00ebs s\u00eb dikujt \u2013 qoft\u00eb e drejta p\u00ebr jet\u00ebn, sh\u00ebndetin, drejt\u00ebsin\u00eb, barazin\u00eb, privat\u00ebsin\u00eb apo dinjitetin. K\u00ebshtu, korrupsioni nuk \u00ebsht\u00eb thjesht nj\u00eb abuzim i detyr\u00ebs publike p\u00ebr p\u00ebrfitime private \u2013 \u00ebsht\u00eb nj\u00eb k\u00ebrc\u00ebnim i drejtp\u00ebrdrejt\u00eb p\u00ebr t\u00eb drejtat e njeriut<\/span><b>.\u00a0<\/b><\/div>\n<div tabindex=\"-1\" role=\"presentation\" aria-setsize=\"-1\" data-qa=\"virtual-list-item\" data-item-key=\"bottomSpacer\">\n<p><span style=\"font-weight: 400;\">Duke vepruar k\u00ebshtu, ndryshe nga format e tjera t\u00eb kriminalitetit q\u00eb kan\u00eb nj\u00eb viktim\u00eb specifike dhe veprim t\u00eb identifikuar, natyra e korrupsionit \u00ebsht\u00eb sistematike dhe e p\u00ebrhapur: n\u00eb vend q\u00eb t\u00eb synoj\u00eb nj\u00eb individ, nj\u00ebkoh\u00ebsisht shkel t\u00eb drejtat e nj\u00eb numri t\u00eb pacaktuar njer\u00ebzish, duke krijuar padrejt\u00ebsi t\u00eb p\u00ebrhapur dhe t\u00eb heshtur. Prandaj, \u00e7\u00ebshtjen e korrupsionit nuk duhet ta shohim vet\u00ebm si nj\u00eb krim q\u00eb duhet t\u00eb \u00e7rr\u00ebnjoset, si nj\u00eb statistik\u00eb n\u00eb pun\u00ebn e gjyq\u00ebsorit, por si nj\u00eb \u00e7\u00ebshtje e t\u00eb drejtave t\u00eb njeriut q\u00eb ndikon n\u00eb sigurin\u00eb e qytetar\u00ebve dhe besimin e tyre n\u00eb institucionet e sistemit.\u00a0<\/span><\/p>\n<p><b>Roli i prokurorit publik n\u00eb luft\u00ebn kund\u00ebr korrupsionit p\u00ebrmes prizmit t\u00eb mbrojtjes s\u00eb t\u00eb drejtave t\u00eb njeriut<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Roli i prokurorit publik n\u00eb luft\u00ebn kund\u00ebr korrupsionit \u00ebsht\u00eb i dyfisht\u00eb.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kryesisht, prokuror\u00ebt publik\u00eb jan\u00eb m\u00eb drejtp\u00ebrdrejt p\u00ebrgjegj\u00ebs p\u00ebr nj\u00eb hetim t\u00eb plot\u00eb, t\u00eb t\u00ebr\u00ebsish\u00ebm dhe efikas t\u00eb t\u00eb gjitha dyshimeve p\u00ebr ekzistenc\u00ebn e krimeve korruptive dhe motiveve korruptive q\u00eb kan\u00eb \u00e7uar n\u00eb shkeljen e t\u00eb drejtave t\u00eb personave. <\/span><a href=\"https:\/\/jorm.gov.mk\/wp-content\/uploads\/2016\/03\/Zakon_za_Krivicna_postapka_150_18112010-2.pdf\"><span style=\"font-weight: 400;\">Ligji p\u00ebr Procedur\u00ebn Penale<\/span><\/a><span style=\"font-weight: 400;\"> e pozicionon qart\u00eb prokurorin si drejtues t\u00eb procedur\u00ebs parahetimore dhe hetimore, duke theksuar nevoj\u00ebn p\u00ebr veprim proaktiv edhe kur organet e prokuroris\u00eb d\u00ebshtojn\u00eb n\u00eb funksionin e tyre t\u00eb zbulimit t\u00eb autor\u00ebve t\u00eb krimeve.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb rastin e krimeve korruptive, v\u00ebrehet aktivitet m\u00eb i madh i autoriteteve t\u00eb p\u00ebrndjekjes n\u00eb ndjekjen penale <\/span><a href=\"https:\/\/24.mk\/details\/krivichni-prijavi-protiv-gradonachalnici-na-opozicijata\"><span style=\"font-weight: 400;\">t\u00eb an\u00ebtar\u00ebve t\u00eb partis\u00eb s\u00eb m\u00ebparshme n\u00eb pushtet<\/span><\/a><span style=\"font-weight: 400;\">, dhe jo an\u00ebtar\u00eb t\u00eb qeveris\u00eb aktuale. Funksionimi i qendrave hetimore brenda prokuroris\u00eb, i kombinuar me rolin udh\u00ebheq\u00ebs t\u00eb prokurorit publik n\u00eb procedimet penale, duhet t\u00eb veproj\u00eb si nj\u00eb kund\u00ebrpesh\u00eb ndaj pasivitetit t\u00eb organeve t\u00eb prokuroris\u00eb n\u00eb zbulimin e rasteve aktuale t\u00eb korrupsionit dhe n\u00eb hedhjen drit\u00eb mbi motivet e mundshme korruptive t\u00eb ushtruesve t\u00eb detyr\u00ebs, q\u00eb kan\u00eb \u00e7uar n\u00eb shkelje t\u00eb t\u00eb drejtave t\u00eb qytetar\u00ebve.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sipas praktik\u00ebs s\u00eb Gjykat\u00ebs Evropiane t\u00eb t\u00eb Drejtave t\u00eb Njeriut, pasi t\u00eb jet\u00eb krijuar nj\u00eb shkelje e nj\u00eb t\u00eb drejte, shteti ka nj\u00eb detyrim ligjor p\u00ebr t\u00eb kryer nj\u00eb hetim t\u00eb plot\u00eb, efikas dhe t\u00eb pavarur \u2013 i ashtuquajturi detyrimi i provimit institucional, brenda t\u00eb cilit do t\u00eb hetohen t\u00eb gjitha rrethanat q\u00eb \u00e7uan n\u00eb shkeljen e nj\u00eb t\u00eb drejte t\u00eb ve\u00e7ant\u00eb. Megjith\u00ebse nuk ka asnj\u00eb rast specifik n\u00eb praktik\u00ebn e Gjykat\u00ebs Evropiane t\u00eb t\u00eb Drejtave t\u00eb Njeriut ku theksohet se hetimi n\u00eb m\u00ebnyr\u00eb specifike duhet t\u00eb kishte hetuar aspektet korruptive q\u00eb \u00e7uan n\u00eb shkeljen e t\u00eb drejtave t\u00eb personave, p\u00ebrs\u00ebri mund t\u00eb konkludohet indirekt se detyrimi p\u00ebr t\u00eb shqyrtuar institucionalisht t\u00eb gjitha rrethanat q\u00eb \u00e7uan n\u00eb shkeljen e t\u00eb drejtave t\u00eb personave do t\u00eb thot\u00eb gjithashtu nj\u00eb detyrim p\u00ebr t\u00eb hetuar t\u00ebr\u00ebsisht aspektet korruptive q\u00eb kan\u00eb ndikuar n\u00eb ushtrimin e t\u00eb drejtave t\u00eb individ\u00ebve.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Historia e koh\u00ebve t\u00eb fundit nuk mban mend t\u00eb ket\u00eb pasur ndonj\u00eb protest\u00eb civile pa sloganin \u201cKorrupsioni vret\u201d: duke nisur nga protestat kund\u00ebr ndotjes, <\/span><a href=\"https:\/\/www.slobodnaevropa.mk\/a\/krvavi-tragi-pred-vlada-i-obvinitelstvo-se-baraat-ostavki-za-sluchajot-onkologija-\/32578250.html\"><span style=\"font-weight: 400;\">protestat pas zbulimit t\u00eb abuzimeve t\u00eb klinik\u00ebs onkologjike<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/meta.mk\/vinovnicite-imaat-ime-tetovci-protestiraa-za-tragediite-vo-koi-izgorea-lugje\/\"><span style=\"font-weight: 400;\">protestat e t\u00eb l\u00ebnduarve n\u00eb aksidentin n\u00eb Llaskarc\u00eb, deri te protestat pas zjarrit t\u00eb spitalit modular n\u00eb Tetov\u00eb<\/span><\/a><span style=\"font-weight: 400;\"> dhe <\/span><a href=\"https:\/\/www.dw.com\/mk\/makedonija-infernoto-vo-kocani-kako-rezultat-na-deceniska-negriza-i-korupcija\/a-71963296\"><span style=\"font-weight: 400;\">zjarrit n\u00eb diskotek\u00ebn Puls n\u00eb Ko\u00e7ani<\/span><\/a><span style=\"font-weight: 400;\">. N\u00eb t\u00eb gjitha k\u00ebto protesta, korrupsioni theksohet si fajtori kryesor p\u00ebr jet\u00ebt e humbura, k\u00ebshtu q\u00eb gishti drejtohet nga gjyq\u00ebsori q\u00eb pritet t\u00eb jap\u00eb verdiktin p\u00ebrfundimtar: a ka \u00e7uar korrupsioni deri te shkelja e s\u00eb drejt\u00ebs p\u00ebr jet\u00eb dhe a e paguajm\u00eb \u00e7mimin e korrupsionit edhe me viktima njer\u00ebzore?\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aspekti i dyt\u00eb q\u00eb \u00ebsht\u00eb i r\u00ebnd\u00ebsish\u00ebm n\u00eb luft\u00ebn kund\u00ebr korrupsionit \u00ebsht\u00eb q\u00ebndrimi personal i prokurorit publik ndaj korrupsionit dhe kontributi q\u00eb \u00e7do prokuror publik duhet t\u00eb ket\u00eb n\u00eb uljen e nivelit t\u00eb pranueshm\u00ebris\u00eb s\u00eb korrupsionit n\u00eb shoq\u00ebri. Ky aspekt lidhet m\u00eb drejtp\u00ebrdrejt me ushtrimin e s\u00eb drejt\u00ebs p\u00ebr procedur\u00eb t\u00eb drejt\u00eb dhe qasjen e qytetar\u00ebve n\u00eb drejt\u00ebsi. Kur tregtia me ndikim, ryshfeti ose p\u00ebrkat\u00ebsia partiake ose biznesi jan\u00eb vendimtare brenda procedurave, dhe jo provat dhe ligji, stimulohet nj\u00eb kultur\u00eb e selektivitetit dhe mosnd\u00ebshkimit.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Megjith\u00ebse bart\u00ebsit e funksioneve publike n\u00eb gjyq\u00ebsor \u2013 gjyqtar\u00ebt dhe prokuror\u00ebt publik\u00eb, duke zgjedhur profesionin e tyre, kan\u00eb zgjedhur t&#8217;i sh\u00ebrbejn\u00eb interesit publik dhe t\u00eb vendosin interesin e tyre vetjak n\u00eb vend t\u00eb dyt\u00eb, ne ende d\u00ebshmojm\u00eb veprime t\u00eb kund\u00ebrta n\u00eb praktik\u00eb. N\u00eb vendin ton\u00eb njihet fenomeni i zgjedhjes s\u00eb gjyqtar\u00ebve dhe prokuror\u00ebve publik\u00eb nga <\/span><a href=\"https:\/\/360stepeni.mk\/unapreduvane-po-zaslugi-ili-po-nekoe-n\/\"><span style=\"font-weight: 400;\">fletoret dhe listat politike<\/span><\/a><span style=\"font-weight: 400;\">, t\u00eb cilat m\u00eb von\u00eb pritet t\u00eb punojn\u00eb p\u00ebr zgjedhjen e tyre dhe mbrohen nga strukturat politike p\u00ebrmes listave t\u00eb t\u00eb cilave jan\u00eb zgjedhur ose promovuar. Nga ana tjet\u00ebr, profesionist\u00ebt q\u00eb luftojn\u00eb korrupsionin jan\u00eb t\u00eb rezervuar p\u00ebr <\/span><a href=\"https:\/\/www.echr.coe.int\/documents\/d\/echr\/fs_independence_justice_eng\"><span style=\"font-weight: 400;\">praktika dhe pasoja diskriminuese, duke nisur nga mobingu e deri te parandalimi i p\u00ebrparimit n\u00eb karrier\u00eb dhe shkarkimi i tyre<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">K\u00ebto praktika diskriminuese n\u00eb rastet e korrupsionit kan\u00eb nj\u00eb rol t\u00eb dyfisht\u00eb: t\u00eb dekurajojn\u00eb individ\u00ebt nga luftimi i korrupsionit dhe t&#8217;u d\u00ebrgojn\u00eb nj\u00eb mesazh profesionist\u00ebve dhe publikut t\u00eb gjer\u00eb se vet\u00ebm ata q\u00eb akomodojn\u00eb pritshm\u00ebrit\u00eb e cent\u00ebve t\u00eb pushtetit jan\u00eb t\u00eb pranuesh\u00ebm p\u00ebr sistemin.
