N\u00eb k\u00ebt\u00eb kontekst,\u00a0<a href=\"https:\/\/rm.coe.int\/16807482bf#_ftn1\" target=\"_blank\" rel=\"noopener\">K\u00ebshilli Konsultativ i Gjyqtar\u00ebve Evropian<\/a>\u00a0arrin n\u00eb p\u00ebrfundimin se cil\u00ebsia e vendimeve gjyq\u00ebsore \u00ebsht\u00eb nj\u00eb komponent kryesor i cil\u00ebsis\u00eb s\u00eb drejt\u00ebsis\u00eb, dhe kjo, n\u00eb nj\u00eb mas\u00eb t\u00eb madhe, mund t\u00eb arrihet p\u00ebrmes shpjegimit dhe argumentimit t\u00eb duhur. Prandaj, ekziston nevoja p\u00ebr nj\u00eb sistem p\u00ebr kontrollimin e cil\u00ebsis\u00eb s\u00eb vendimeve t\u00eb gjykatave dhe arsyetimet e tyre, i cili n\u00ebse zbatohet me metoda t\u00eb buta p\u00ebrve\u00e7 rishikimit t\u00eb rregullt t\u00eb vendimeve nga gjykatat m\u00eb t\u00eb larta, si\u00e7 \u00ebsht\u00eb kritika akademike, mund t\u00eb kontribuoj\u00eb n\u00eb p\u00ebrmir\u00ebsimin dhe promovimin e kultur\u00ebs juridike.<\/p>\n<p>E drejta p\u00ebr vendime t\u00eb arsyetuara \u00ebsht\u00eb nj\u00eb komponent kryesor p\u00ebr nj\u00eb seanc\u00eb t\u00eb drejt\u00eb d\u00ebgjimore bazuar n\u00eb praktik\u00ebn e Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut (KEDNJ), dhe e nj\u00ebjta bazohet pik\u00ebrisht n\u00eb disa parime t\u00eb p\u00ebrgjithshme t\u00eb mish\u00ebruara n\u00eb vet\u00eb Konvent\u00ebn, t\u00eb cilat k\u00ebshtu,\u00a0<a href=\"https:\/\/hudoc.echr.coe.int\/eng#{%22fulltext%22:[%22Roche%20v.%20the%20United%20Kingdom%20[GC]%22],%22documentcollectionid2%22:[%22GRANDCHAMBER%22,%22CHAMBER%22],%22itemid%22:[%22001-70662%22]}\" target=\"_blank\" rel=\"noopener\">mbrojn\u00eb individin nga arbitrariteti i institucioneve<\/a>. Pik\u00ebrisht p\u00ebr k\u00ebt\u00eb arsye, vendimet domosdoshm\u00ebrisht duhet t\u00eb p\u00ebrmbajn\u00eb arsye q\u00eb do t\u00eb ishin t\u00eb k\u00ebnaqshme n\u00eb t\u00eb cilat do t\u00eb bazohej vendimi i gjykat\u00ebs, por edhe t&#8217;u japin p\u00ebrgjigje aspekteve thelb\u00ebsore q\u00eb pal\u00ebt n\u00eb procedur\u00eb i prezantojn\u00eb si argumentet e tyre juridike.<\/p>\n<p>Vendimet e arsyetuara japin p\u00ebrshtypjen se rasti i tyre v\u00ebrtet \u00ebsht\u00eb shqyrtuar, analizuar dhe p\u00ebrpunuar n\u00eb m\u00ebnyr\u00eb p\u00ebrkat\u00ebse, duke futur k\u00ebshtu besim te pal\u00ebt, por gjithashtu duke kontribuar n\u00eb promovimin e besimit t\u00eb publikut n\u00eb vendimmarrjen e gjykatave dhe duke siguruar nj\u00eb baz\u00eb t\u00eb q\u00ebndrueshme p\u00ebr sundimin e ligjit. Arsyetimi i vendimeve gjyq\u00ebsore \u00ebsht\u00eb i nj\u00eb r\u00ebnd\u00ebsie t\u00eb ve\u00e7ant\u00eb duke marr\u00eb parasysh se ai gjithashtu kontribuon n\u00eb fitimin e besimit t\u00eb publikut n\u00eb drejt\u00ebsin\u00eb e drejt\u00eb, objektive dhe transparente si shtylla t\u00eb nj\u00eb shoq\u00ebri demokratike.<\/p>\n<p>Nga ana tjet\u00ebr, sigurimi i zbatimit uniform t\u00eb ligjeve dhe uniformitetin e praktik\u00ebs gjyq\u00ebsore kontribuon n\u00eb\u00a0<a href=\"https:\/\/hudoc.echr.coe.int\/fre#{%22itemid%22:[%22001-110805%22]}\" target=\"_blank\" rel=\"noopener\">arritjen e siguris\u00eb juridike<\/a>. Praktika e GJEDNJ-s\u00eb thekson r\u00ebnd\u00ebsin\u00eb e sigurimit t\u00eb nj\u00eb praktike gjyq\u00ebsore t\u00eb vetme nga ana e gjykatave m\u00eb t\u00eb larta t\u00eb shteteve. Praktikat e ndryshme n\u00eb gjykata t\u00eb ndryshme n\u00eb nj\u00eb shtet mund t\u00eb minojn\u00eb parimin e siguris\u00eb juridike. Praktika gjyq\u00ebsore mund t\u00eb evoluoj\u00eb me kalimin e koh\u00ebs dhe t\u00eb p\u00ebrshtatet, megjithat\u00eb GJEDNJ-ja thekson se \u00ebsht\u00eb e nevojshme q\u00eb individi t\u00eb jet\u00eb n\u00eb gjendje t\u00eb udh\u00ebhiqet nga vendimet e gjykatave t\u00eb marra n\u00eb raste t\u00eb m\u00ebparshme t\u00eb ngjashme, p\u00ebrve\u00e7 n\u00ebse ka arsye t\u00eb parr\u00ebzueshme p\u00ebr t&#8217;iu shmangur praktik\u00ebs s\u00eb p\u00ebrcaktuar m\u00eb par\u00eb.<\/p>\n<p>P\u00ebr t\u00eb p\u00ebrcaktuar cil\u00ebsin\u00eb dhe uniformitetin e vendimeve gjyq\u00ebsore n\u00eb nivelin e gjykatave themelore dhe t\u00eb apelit n\u00eb Republik\u00ebn e Maqedonis\u00eb s\u00eb Veriut, si dhe n\u00eb p\u00ebrgjith\u00ebsi n\u00eb nivel komb\u00ebtar, Instituti p\u00ebr Politik\u00eb Evropiane (EPI) &#8211; Shkup, gjat\u00eb k\u00ebtij viti kreu nj\u00eb analiz\u00eb t\u00eb cil\u00ebsis\u00eb dhe uniformitetit t\u00eb vendimeve gjyq\u00ebsore. N\u00eb k\u00ebt\u00eb analiz\u00eb ishin trajtuar \u00e7\u00ebshtje q\u00eb lidhen me struktur\u00ebn dhe koherenc\u00ebn e vendimit t\u00eb gjykat\u00ebs, logjik\u00ebn juridike, konsistenc\u00ebn e p\u00ebrmbajtjes s\u00eb arsyetimeve me p\u00ebrmbajtjen e aktgjykimeve, si dhe cil\u00ebsin\u00eb e arsyetimit t\u00eb vendimeve gjyq\u00ebsore, por edhe cil\u00ebsin\u00eb e aktgjykimeve nga aspekti i korrekt\u00ebsis\u00eb s\u00eb tyre gjuh\u00ebsore dhe gramatikore. P\u00ebr q\u00ebllimet e analiz\u00ebs, ishin rishikuar 61 aktgjykime nga aspekti i p\u00ebrmbushjes s\u00eb standardeve t\u00eb cil\u00ebsis\u00eb dhe 10 aktgjykime n\u00eb lidhje me uniformitetin e vendimeve gjyq\u00ebsore, t\u00eb shqiptuara nga gjykatat themelore dhe ato t\u00eb apelit n\u00eb vend, p\u00ebr nj\u00eb periudh\u00eb kohore prej 4 vjet.<\/p>\n<p>P\u00ebrfundimet e prezantuara n\u00eb k\u00ebt\u00eb blog jan\u00eb pjes\u00eb e &#8220;Analiz\u00ebs s\u00eb cil\u00ebsis\u00eb dhe uniformitetit t\u00eb vendimeve gjyq\u00ebsore n\u00eb sfer\u00ebn juridike-penale&#8221;, p\u00ebrgatitur nga Natali Petrovska. Analiza \u00ebsht\u00eb p\u00ebrgatitur n\u00eb baz\u00eb t\u00eb kritereve dhe treguesve t\u00eb p\u00ebrcaktuar n\u00eb Metodologjin\u00eb e zhvilluar posa\u00e7\u00ebrisht p\u00ebr analiz\u00ebn e cil\u00ebsis\u00eb dhe uniformitetit t\u00eb vendimeve gjyq\u00ebsore. Analiza dhe metodologjia jan\u00eb kryer n\u00eb kuad\u00ebr t\u00eb projektit \u201e<a href=\"https:\/\/epi.org.mk\/wp-content\/uploads\/2019\/03\/%D0%A0%D0%B5%D0%B7%D0%B8%D0%BC%D0%B5_%D0%88%D1%83%D1%81%D1%82%D0%B8%D1%86%D0%B8%D1%98%D0%B0_MK_web.pdf\" target=\"_blank\" rel=\"noopener\">Partneriteti Justicia: Rivendosja e besimit t\u00eb qytetar\u00ebve<\/a>\u201c i zbatuar nga Instituti p\u00ebr Politik\u00eb Evropiane dhe Asociacioni p\u00ebr Iniciativa Zhvillimore &#8211; Zenit, projekt q\u00eb \u00ebsht\u00eb mb\u00ebshtetur financiarisht nga Bashkimi Evropian.<\/p>\n<h5><strong>Cil\u00ebsia e vendimeve gjyq\u00ebsore<\/strong><\/h5>\n<p>Cil\u00ebsia e vendimeve gjyq\u00ebsore varet jo vet\u00ebm nga gjyqtari individual q\u00eb merret me \u00e7\u00ebshtjen, por edhe nga nj\u00eb num\u00ebr i konsideruesh\u00ebm faktor\u00ebsh t\u00eb jasht\u00ebm dhe t\u00eb brendsh\u00ebm. Cil\u00ebsia e legjislacionit, burimet e nevojshme n\u00eb dispozicion t\u00eb sistemit gjyq\u00ebsor, cil\u00ebsia e zhvillimit profesional t\u00eb gjyqtar\u00ebve, profesionalizmi i gjyqtar\u00ebve, efikasiteti i tyre, parimi i funksionimit dhe m\u00ebnyra e kryerjes s\u00eb procedur\u00ebs do t\u00eb ve\u00e7oheshin si faktor\u00eb kryesor\u00eb. T\u00eb gjith\u00eb k\u00ebta faktor\u00eb ndikojn\u00eb n\u00eb m\u00ebnyr\u00ebn se si do t\u00eb p\u00ebrpiloheshin vendimet gjyq\u00ebsore, si dhe cil\u00ebsia e tyre, e cila \u00ebsht\u00eb thelb\u00ebsore p\u00ebr ekzistimin e jurisprudenc\u00ebs q\u00eb do t\u00eb ofroj\u00eb ushtrimin dhe sigurimin e lirive dhe t\u00eb drejtave themelore t\u00eb qytetar\u00ebve, si dhe subjekteve t\u00eb tjera n\u00eb vend.<\/p>\n<p>P\u00ebrfundimet nga analiza e kryer tregojn\u00eb p\u00ebr faktin se n\u00eb nivel komb\u00ebtar, n\u00eb nj\u00eb pjes\u00eb mbizot\u00ebruese, vendimet e gjykatave kompetente kan\u00eb nj\u00eb struktur\u00eb t\u00eb sakt\u00eb, duke p\u00ebrfshir\u00eb pajtueshm\u00ebrin\u00eb e plot\u00eb me standardet e parashikuara mbi elementet q\u00eb duhet t\u00eb p\u00ebrmbaj\u00eb nj\u00eb aktgjykim. Ato ndiqen nga dispozita t\u00eb qarta dhe koncize q\u00eb jan\u00eb logjikisht n\u00eb p\u00ebrputhje me arsyetimet dhe p\u00ebrfaq\u00ebsojn\u00eb nj\u00eb t\u00ebr\u00ebsi koherente dhe jo kontradiktore.<\/p>\n<p>Ajo q\u00eb u identifikua ende si sfid\u00eb \u00ebsht\u00eb ekzistenca e logjik\u00ebs juridike, respektivisht shpjegimi adekuat i rregullave juridike n\u00eb baz\u00eb t\u00eb t\u00eb cilave arrihet n\u00eb p\u00ebrfundimin se n\u00eb nivel komb\u00ebtar gjykatat nuk i kushtojn\u00eb v\u00ebmendje t\u00eb mjaftueshme arsyetimit m\u00eb thelb\u00ebsor dhe p\u00ebrcaktimit t\u00eb rregullave juridike n\u00eb aktgjykimet. Vendimet gjyq\u00ebsore duhet t\u00eb jen\u00eb t\u00eb qarta dhe koncize, por pavar\u00ebsisht k\u00ebsaj, n\u00eb disa vendime individuale t\u00eb gjykatave n\u00eb nivel komb\u00ebtar, jan\u00eb identifikuar paragraf\u00eb t\u00eb gjer\u00eb q\u00eb duhet t\u00eb trajtojn\u00eb segmente t\u00eb ndryshme t\u00eb situat\u00ebs faktike, dhe t\u00eb cilat jan\u00eb t\u00eb v\u00ebshtira p\u00ebr t&#8217;u ndjekur nga ana e qytetar\u00ebve. Prandaj, ekziston nevoja p\u00ebr t\u00eb ndryshuar k\u00ebt\u00eb praktik\u00eb dhe braktisjen graduale t\u00eb saj, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb ngrihet niveli i cil\u00ebsis\u00eb s\u00eb arsyetimeve t\u00eb p\u00ebrpiluara dhe n\u00eb mas\u00eb t\u00eb madhe t\u00eb ofrohet monitorim i leht\u00ebsuar i p\u00ebrmbajtjes s\u00eb aktgjykimeve.<\/p>\n<p>N\u00eb disa nga aktgjykimet e analizuara, nuk ka asnj\u00eb arsyetim dhe argumentim t\u00eb detajuar p\u00ebr (jo)r\u00ebnd\u00ebsin\u00eb e provave duke p\u00ebrdorur nj\u00eb qasje individuale p\u00ebr secil\u00ebn prej tyre, e cila deri diku kontribuon n\u00eb uljen e nivelit t\u00eb cil\u00ebsis\u00eb s\u00eb vendimeve gjyq\u00ebsore, por edhe mungesa e arsyetimit thelb\u00ebsor n\u00eb drejtim t\u00eb mos marrjes parasysh t\u00eb argumenteve t\u00eb t\u00eb dy pal\u00ebve n\u00eb procedur\u00eb.<\/p>\n<p>Si nj\u00eb nga problemet thelb\u00ebsore t\u00eb v\u00ebrejtura gjat\u00eb kryerjes s\u00eb hulumtimit \u00ebsht\u00eb mungesa e praktik\u00ebs p\u00ebr rregullimin e duhur ose n\u00eb disa raste t\u00eb ndonj\u00eb interpretimi t\u00eb norm\u00ebs ligjore p\u00ebr secil\u00ebn \u00e7\u00ebshtje q\u00eb \u00ebsht\u00eb n\u00eb diskutim. N\u00eb m\u00ebnyr\u00eb identike, \u00ebsht\u00eb konstatuar t\u00eb jet\u00eb mjaft problematik edhe fakti q\u00eb gjykatat rrall\u00eb i kushtojn\u00eb v\u00ebmendje p\u00ebrpunimit t\u00eb holl\u00ebsish\u00ebm t\u00eb vepr\u00ebs penale, karakteristikave dhe qenies s\u00eb saj, si dhe subjektit t\u00eb mbrojtjes, pra t\u00eb mir\u00ebs mbrojt\u00ebse,. Si nj\u00eb vler\u00eb e shtuar p\u00ebr rritjen e nivelit t\u00eb cil\u00ebsis\u00eb s\u00eb aktgjykimeve, nj\u00eb referenc\u00eb n\u00eb praktik\u00ebn vendase ose gjyq\u00ebsore t\u00eb Gjykat\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut sigurisht q\u00eb do t\u00eb kontribuonte, di\u00e7ka q\u00eb \u00ebsht\u00eb deklaruar n\u00eb nj\u00eb num\u00ebr t\u00eb par\u00ebnd\u00ebsish\u00ebm ose t\u00eb vog\u00ebl &#8211; n\u00eb nj\u00eb aktgjykim nga i gjith\u00eb numri i aktgjykimeve t\u00eb p\u00ebrpunuara.<\/p>\n<p>Elementi i fundit q\u00eb kontribuon n\u00eb cil\u00ebsin\u00eb teknike t\u00eb aktgjykimeve \u00ebsht\u00eb p\u00ebrdorimi i gjuh\u00ebs n\u00eb to, si dhe rregullat drejtshkrimore t\u00eb gjuh\u00ebs maqedonase. P\u00ebrfundimi n\u00eb k\u00ebt\u00eb pjes\u00eb p\u00ebr vendimet n\u00eb nivel komb\u00ebtar \u00ebsht\u00eb se ato nuk l\u00ebn\u00eb p\u00ebrshtypjen se posedojn\u00eb nj\u00eb nivel t\u00eb mjaftuesh\u00ebm t\u00eb sakt\u00ebsis\u00eb s\u00eb k\u00ebnaqshme gjuh\u00ebsore dhe gramatikore. Gjat\u00eb p\u00ebrgatitjes me shkrim t\u00eb disa vendimeve, ishte p\u00ebrdor nj\u00eb dialekt lokal, karakteristik p\u00ebr pjes\u00eb t\u00eb caktuara t\u00eb vendit, dhe gjithashtu u regjistruan edhe l\u00ebshime t\u00eb caktuara gjat\u00eb aplikimit t\u00eb drejtshkrimit maqedonas, si dhe gabime teknike n\u00eb shkrim. E cila tregon vet\u00ebm nevoj\u00ebn urgjente p\u00ebr v\u00ebmendje t\u00eb shtuar n\u00eb p\u00ebrgatitjen e aktgjykimeve, si dhe minimizimin e rrezikut t\u00eb krijimit t\u00eb gabimeve tipografike dhe teknike me rastin e p\u00ebrgatitjes s\u00eb aktgjykimeve\/vendimeve.<\/p>\n<p>\u00cbsht\u00eb e pashmangshme t\u00eb theksohet se cil\u00ebsia e vendimeve gjyq\u00ebsore lidhet drejtp\u00ebrdrejt me munges\u00ebn e stafit n\u00eb gjykata, ve\u00e7an\u00ebrisht gjyqtar\u00ebt (sipas sistemimit t\u00eb vendeve t\u00eb pun\u00ebs) n\u00eb nivelin e gjykatave themelore. Rrethanat e vendosura n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb pa dyshim \u00e7ojn\u00eb n\u00eb nj\u00eb situat\u00eb ku gjyqtar\u00ebt e caktuar kan\u00eb nj\u00eb sfid\u00eb p\u00ebr t\u00eb kap\u00ebrcyer kuot\u00ebn e parashikuar t\u00eb \u00e7\u00ebshtjeve\/l\u00ebnd\u00ebve t\u00eb zgjidhura. Ngarkesa joproporcionale me pun\u00eb, n\u00eb krahasim me numrin aktiv t\u00eb gjyqtar\u00ebve, \u00e7on n\u00eb nj\u00eb ulje t\u00eb cil\u00ebsis\u00eb s\u00eb vendimeve, ve\u00e7an\u00ebrisht n\u00ebse marrim parasysh koh\u00ebn n\u00eb t\u00eb cil\u00ebn pritet t\u00eb p\u00ebrfundoj\u00eb nj\u00eb l\u00ebnd\u00eb, dhe pastaj p\u00ebr t\u00eb nj\u00ebjtin dhe nj\u00eb vendim t\u00eb marr\u00eb n\u00eb baz\u00eb t\u00eb t\u00eb gjitha kritereve dhe parimeve t\u00eb p\u00ebrcaktuara n\u00eb lidhje me arsyetimin e tij, dhe gjithashtu do t\u00eb sigurojn\u00eb nj\u00eb nivel t\u00eb lart\u00eb t\u00eb cil\u00ebsis\u00eb s\u00eb zbatimit dhe argumentimit t\u00eb drejt\u00ebs materiale, mb\u00ebshtetjen teorike t\u00eb tij, por edhe zbatimin e praktik\u00ebs, si t\u00eb asaj vendase ashtu edhe t\u00eb GJEDNJ-s\u00eb.<\/p>\n<h5><strong>Uniformiteti i vendimeve gjyq\u00ebsore nga k\u00ebndv\u00ebshtrimi i zbatimit t\u00eb institutit\u00a0<em>non bis in idem (ndalimi i gjykimit ose d\u00ebnimit t\u00eb dyfisht\u00eb)<\/em><\/strong><\/h5>\n<p>Bazuar n\u00eb kompetencat dhe rolin e gjykat\u00ebs m\u00eb t\u00eb lart\u00eb n\u00eb vend &#8211; Gjykat\u00ebs Supreme, mund t\u00eb konkludohet se ajo \u00ebsht\u00eb gjith\u00eb koh\u00ebn p\u00ebrgjegj\u00ebse p\u00ebr promovimin e praktik\u00ebs gjyq\u00ebsore, p\u00ebrkat\u00ebsisht sigurimin e uniformitetit n\u00eb zbatimin e ligjeve nga ana e gjykatave. Duke siguruar uniformitet n\u00eb zbatimin e ligjeve, Gjykata Supreme e arrin at\u00eb duke miratuar, pra duke krijuar q\u00ebndrime parimore, mendime parimore ligjore p\u00ebr \u00e7\u00ebshtje t\u00eb caktuara juridike q\u00eb jan\u00eb t\u00eb detyrueshme p\u00ebr Gjykat\u00ebn Supreme t\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut, t\u00eb cilat kan\u00eb ndikim ose jan\u00eb t\u00eb detyrueshme p\u00ebr gjykatat m\u00eb t\u00eb ul\u00ebta n\u00eb vend, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb p\u00ebrmir\u00ebsohet praktika gjyq\u00ebsore, gjegj\u00ebsisht zbatimi i harmonizuar i ligjeve. Me q\u00ebndrimet parimore juridike t\u00eb miratuara n\u00eb Mbledhjen e P\u00ebrgjithshme t\u00eb Gjykat\u00ebs Supreme, ajo, si gjykata m\u00eb e lart\u00eb n\u00eb vend, kontribuon n\u00eb zgjidhjen e \u00e7\u00ebshtjeve t\u00eb r\u00ebnd\u00ebsishme juridike p\u00ebr t\u00eb cilat gjat\u00eb vendimmarrjes, jo vet\u00ebm q\u00eb p\u00ebrpunon dispozitat ligjore q\u00eb jan\u00eb subjekt shqyrtimi, por edhe subjekt shtjellimi dhe arsyetimi \u00ebsht\u00eb fryma e ligjit n\u00eb kontekstin specifik, parimi, si dhe vlerat q\u00eb k\u00ebto dispozita mbrojn\u00eb n\u00eb interes t\u00eb mbrojtjes s\u00eb t\u00eb drejtave t\u00eb njeriut, barazis\u00eb s\u00eb qytetar\u00ebve para ligjit, por edhe sigurin\u00eb juridike n\u00eb nj\u00eb rend juridik.<\/p>\n<p>Nuk \u00ebsht\u00eb e diskutueshme r\u00ebnd\u00ebsia dhe roli i Gjykat\u00ebs Supreme n\u00eb vend n\u00eb sigurimin e praktik\u00ebs gjyq\u00ebsore t\u00eb q\u00ebndrueshme, dhe k\u00ebshtu mbrojtjen e t\u00eb drejtave dhe lirive t\u00eb njeriut, duke siguruar barazin\u00eb para ligjit, si siguri juridike. Megjithat\u00eb, \u00ebsht\u00eb fakt se jo t\u00eb gjitha \u00e7\u00ebshtjet juridike mund t\u00eb jen\u00eb ose jan\u00eb subjekt i harmonizimit nga Gjykata Supreme e RMV-s\u00eb ose ka nisma p\u00ebr uniformitet n\u00eb disa sfera t\u00eb ve\u00e7anta. P\u00ebr shkak t\u00eb s\u00eb cil\u00ebs vet\u00eb koncepti i uniformitetit t\u00eb vendimeve gjyq\u00ebsore p\u00ebr nevojat e analiz\u00ebs s\u00eb m\u00ebsip\u00ebrme u shqyrtua p\u00ebrmes aplikimit t\u00eb institutit juridik\u00a0<em>non bis in idem<\/em><em>.<\/em><\/p>\n<p>Parimi Non bis in idem \u00ebsht\u00eb nj\u00eb parim i p\u00ebrgjithsh\u00ebm n\u00eb t\u00eb drejt\u00ebn penale, pjes\u00eb e shum\u00eb sistemeve juridike, dhe n\u00eb disa sisteme i kodifikuara n\u00eb nivelin e nj\u00eb kategorie kushtetuese. N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, ai \u00ebsht\u00eb vendosur si e drejt\u00eb individuale brenda mekanizmave nd\u00ebrkomb\u00ebtar\u00eb p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut.<\/p>\n<p>Ky parim, i cili parashikon ndalimin e gjykimit ose d\u00ebnimit t\u00eb dyfisht\u00eb t\u00eb nj\u00eb personi p\u00ebr nj\u00eb vep\u00ebr p\u00ebr t\u00eb cilin \u00ebsht\u00eb d\u00ebnuar m\u00eb par\u00eb, tregon faktin se p\u00ebr shkelje t\u00eb nj\u00ebjt\u00eb ose t\u00eb ngjashme t\u00eb ligjit, nuk ka sanksion t\u00eb ngjash\u00ebm ose identik, dhe n\u00eb fakt nuk ka asnj\u00eb veprim identik brenda t\u00eb gjitha gjykatave n\u00eb aktgjykimet e analizuara. Ajo q\u00eb thekson m\u00eb tej nevoj\u00ebn p\u00ebr veprim t\u00eb uniformuar \u00ebsht\u00eb p\u00ebrfundimi se brenda s\u00eb nj\u00ebjt\u00ebs gjykat\u00eb dhe t\u00eb nj\u00ebjtit rajon t\u00eb apelit, nuk ka praktik\u00eb krejt\u00ebsisht identike t\u00eb veprimit. K\u00ebshtu, situata e konstatuar i referohet nj\u00eb logjike t\u00eb ndryshme juridike q\u00eb kan\u00eb zbatuar gjykatat, e cila kryesisht i referohet pasiguris\u00eb juridike n\u00eb sistemin juridik p\u00ebr t\u00eb gjith\u00eb pjes\u00ebmarr\u00ebsit n\u00eb nj\u00eb procedur\u00eb penale, kur b\u00ebhet fjal\u00eb p\u00ebr aplikimin e nj\u00eb instituti identik.<\/p>\n<p>Megjithat\u00eb, k\u00ebto ndryshime drastike n\u00eb zbatimin e k\u00ebtij parimi jan\u00eb regjistruar n\u00eb funksionimin ose pun\u00ebn e nj\u00eb rajoni apelimi n\u00eb vend, p\u00ebr shkak t\u00eb t\u00eb cilave ato nuk mund t\u00eb kontribuojn\u00eb n\u00eb krijimin e nj\u00eb pasqyr\u00eb t\u00eb p\u00ebrgjithshme t\u00eb jouniformitetit absolut n\u00eb praktik\u00ebn e pun\u00ebs s\u00eb gjykatave n\u00eb vend.
