L&#8217;impasse <a href=\"https:\/\/www.consilium.europa.eu\/media\/41123\/17-18-euco-final-conclusions-en.pdf\">\u00a0\u00a0<span style=\"text-decoration: underline;\">du Conseil d&#8217;octobre 2019 <\/span><\/a>\u00a0\u00a0suivie du \u00a0\u00a0\u00a0non-paper fran\u00e7ais \u00a0\u00a0pour la r\u00e9forme du processus d&#8217;adh\u00e9sion \u00e0 l&#8217;UE a suscit\u00e9 un d\u00e9bat n\u00e9cessaire sur les voies \u00e0 suivre en vue de r\u00e9viser la m\u00e9thodologie d&#8217;\u00e9largissement. Les discussions entre les \u00c9tats membres ont jusqu&#8217;\u00e0 pr\u00e9sent mis au jour des points de vue oppos\u00e9s, allant d&#8217;appels <a href=\"https:\/\/europeanwesternbalkans.com\/2019\/12\/11\/nine-eu-members-release-a-new-proposal-for-the-reform-of-enlargement-process\/\">\u00a0\u00a0<span style=\"text-decoration: underline;\">au d\u00e9marrage rapide des n\u00e9gociations d&#8217;adh\u00e9sion <\/span><\/a>\u00a0\u00a0\u00e0 <a href=\"https:\/\/www.politico.eu\/article\/macron-urges-reform-of-bizarre-system-for-eu-hopefuls\/\">\u00a0\u00a0<span style=\"text-decoration: underline;\">la remise en question de la perspective d&#8217;adh\u00e9sion de la r\u00e9gion <\/span><\/a>. La Commission europ\u00e9enne, r\u00e9cemment cr\u00e9\u00e9e en tant qu&#8217;organe charg\u00e9 de cette t\u00e2che, devrait pr\u00e9senter une proposition sur la voie \u00e0 suivre dans un d\u00e9lai largement irr\u00e9aliste, c&#8217;est-\u00e0-dire au d\u00e9but de 2020. Il va sans dire que les conditions de cet exercice sont loin d&#8217;\u00eatre id\u00e9ales, allant d&#8217;une faible confiance entre la r\u00e9gion et les \u00c9tats membres de l&#8217;UE, ainsi qu&#8217;entre les \u00c9tats membres de l&#8217;UE d&#8217;une part et la Commission europ\u00e9enne de l&#8217;autre.<\/p>\n<p>Les querelles politiques entre les \u00c9tats membres et les institutions de l&#8217;UE ont jusqu&#8217;\u00e0 pr\u00e9sent cr\u00e9\u00e9 beaucoup de bruit, mais sans beaucoup de substance. Dans le m\u00eame temps, peu d&#8217;attention a \u00e9t\u00e9 accord\u00e9e aux opinions et aux besoins des pays candidats en tant que b\u00e9n\u00e9ficiaires de la conditionnalit\u00e9 de l&#8217;UE. Ce blog pr\u00e9sente certains des points importants du point de vue des pays candidats, en particulier la Mac\u00e9doine du Nord en tant que candidat le plus exp\u00e9riment\u00e9 \u00e0 l&#8217;adh\u00e9sion \u00e0 l&#8217;UE dans la r\u00e9gion et un cas dans lequel la m\u00e9thodologie r\u00e9vis\u00e9e est la plus susceptible d&#8217;\u00eatre applicable. Il se concentre sur trois \u00e9l\u00e9ments: maintenir la logique des processus politiques d\u00e9j\u00e0 \u00e9tablis, garantir la clart\u00e9 des conditions et de leur \u00e9valuation, ainsi que surmonter la nature ex\u00e9cutive du processus d&#8217;adh\u00e9sion.<\/p>\n<p>Premi\u00e8rement, toute r\u00e9vision ou intervention de la m\u00e9thodologie de l&#8217;\u00e9largissement doit reconna\u00eetre que les n\u00e9gociations d&#8217;adh\u00e9sion pour ces pays ne sont pas un point z\u00e9ro d&#8217;engagement avec l&#8217;UE, mais de nombreuses \u00e9tapes suppl\u00e9mentaires. La Mac\u00e9doine du Nord, par exemple, a sign\u00e9 un accord de stabilisation et d&#8217;association (ASA) avec l&#8217;UE depuis pr\u00e8s de 19 ans. L&#8217;utilisation de ce fait dans les discussions politiques comme exemple du temps pass\u00e9 dans la salle d&#8217;attente de l&#8217;UE a conduit \u00e0 saper ses implications politiques pour le pays candidat. Compte tenu de ce dernier, l&#8217;ASA propose un vaste programme d&#8217;alignement l\u00e9gislatif et contribue \u00e0 la socialisation des d\u00e9cideurs politiques du pays candidat et de l&#8217;UE. Le programme d&#8217;alignement l\u00e9gislatif a donn\u00e9 la priorit\u00e9 au march\u00e9 int\u00e9rieur, qui est un sujet souvent oubli\u00e9 ces derni\u00e8res ann\u00e9es, en particulier par les \u00c9tats membres qui se sont prononc\u00e9s r\u00e9cemment sur l&#8217;\u00e9largissement. Dans le m\u00eame temps, la mise en \u0153uvre de cet accord a n\u00e9cessit\u00e9 la mise en place et le fonctionnement de nombreux organes op\u00e9rationnels qui ont largement contribu\u00e9 \u00e0 socialiser ses d\u00e9cideurs politiques aupr\u00e8s des institutions europ\u00e9ennes. Par cons\u00e9quent, le programme d&#8217;action propos\u00e9 par les ASA est ancr\u00e9 dans les syst\u00e8mes institutionnels de ces pays dans le but d&#8217;adh\u00e9rer \u00e0 l&#8217;UE.\u00a0 Dans le m\u00eame temps, l&#8217;interaction entre les candidats et les institutions de l&#8217;UE a \u00e9galement consist\u00e9 \u00e0 pr\u00e9parer ces pays \u00e0 devenir de futurs membres de l&#8217;Union. Compte tenu de cela, l&#8217;am\u00e9lioration de la m\u00e9thodologie doit renforcer ces efforts et \u00e9viter d&#8217;obstruire les processus politiques \u00e9tablis de longue date.<\/p>\n<p>Deuxi\u00e8mement, si l&#8217;\u00e9tat de droit a domin\u00e9 le discours de l&#8217;adh\u00e9sion, peu a \u00e9t\u00e9 fait pour traiter\u00a0 la clart\u00e9 des conditions, ainsi que pour \u00e9tablir un mode d\u2019\u00e9valuation fiable \u00e0 cet \u00e9gard, qui sont les besoins principaux des pays candidats. Les cas d&#8217;octobre 2019 de la Mac\u00e9doine du Nord et de l&#8217;Albanie sont une illustration r\u00e9cente du probl\u00e8me, car l&#8217;\u00e9valuation de la Commission europ\u00e9enne n&#8217;a clairement pas \u00e9t\u00e9 approuv\u00e9e par les \u00c9tats membres. La dissonance des \u00e9valuations est surtout pr\u00e9sente par rapport \u00e0 la conditionnalit\u00e9 de l&#8217;\u00e9tat de droit, en tant que domaines politiques avec le moins de clart\u00e9 de banchmarking. Dans le m\u00eame temps, c&#8217;est le domaine dans lequel les pays traditionnellement bruyants en mati\u00e8re d&#8217;\u00e9largissement n\u00e9cessitent un examen plus approfondi et un engagement accru des \u00c9tats membres. Si l&#8217;engagement des \u00c9tats membres est toujours bienvenu et n\u00e9cessaire, un manque persistant de clart\u00e9 des conditions et de leur mode d&#8217;\u00e9valuation obstruit encore plus la cr\u00e9dibilit\u00e9 de la conditionnalit\u00e9. Par cons\u00e9quent, les r\u00e9visions de la m\u00e9thodologie, parall\u00e8lement au renforcement de la conditionnalit\u00e9 de l&#8217;\u00e9tat de droit, doivent au moins contribuer \u00e0 \u00e9liminer le brouillard par rapport aux normes et aux \u00e9valuateurs acceptables \u00e0 cette fin. Les avanc\u00e9es r\u00e9centes en mati\u00e8re de benchmarking de l&#8217;\u00e9tat de droit dans l&#8217;UE contribueront \u00e0 cet objectif \u00e0 long terme, mais pour la p\u00e9riode imm\u00e9diate, la Commission doit suivre ou r\u00e9fl\u00e9chir \u00e0 son diagnostic d\u00e9j\u00e0 pr\u00e9sent\u00e9 dans la communication de 2018 sur la perspective d&#8217;\u00e9largissement cr\u00e9dible<a href=\"https:\/\/ec.europa.eu\/commission\/sites\/beta-political\/files\/communication-credible-enlargement-perspective-western-balkans_en.pdf\"> \u00a0\u00a0<span style=\"text-decoration: underline;\">2018<\/span><\/a> \u00a0avec les Balkans occidentaux.<\/p>\n<p>Troisi\u00e8mement, les discussions en cours sur les r\u00e9visions de la m\u00e9thodologie ne traitent pas la nature centr\u00e9e ex\u00e9cutive du processus d&#8217;adhesion comme l&#8217;un des fl\u00e9aux d&#8217;adh\u00e9sion traditionnellement reconnus. Dans les conditions de pouvoirs executifs forts dans la r\u00e9gion, cette approche contribue en effet \u00e0 exclure une multitude d&#8217;acteurs du processus d&#8217;adh\u00e9sion, tels que les parlements, le judiciaire et la soci\u00e9t\u00e9 civile. Ces acteurs importants et acteurs du changement soci\u00e9tal sont souvent consid\u00e9r\u00e9s comme marginaux par rapport \u00e0 l&#8217;essentiel de l&#8217;\u00e9largissement et doivent trouver leur propre place en partenariat avec leurs homologues des institutions de l&#8217;UE et des \u00c9tats membres. \u00c0 cette fin, cependant, le processus d&#8217;adh\u00e9sion devra passer d&#8217;une relation tr\u00e8s asym\u00e9trique \u00e0 une relation de partenariat avec les parties prenantes des futurs \u00c9tats membres. Pour y parvenir, l&#8217;engagement avec les pays candidats du c\u00f4t\u00e9 des institutions de l&#8217;UE et des \u00c9tats membres devra s&#8217;\u00e9tendre au-del\u00e0 des services d&#8217;\u00e9largissement et des bureaux de politique \u00e9trang\u00e8re de l&#8217;UE pour \u00e9tablir des relations horizontales dans divers domaines politiques. Un tel engagement devrait \u00eatre intentionnel, \u00e0 long terme et contribuerait \u00e9galement de mani\u00e8re significative \u00e0 instaurer la confiance et \u00e0 soutenir le processus d&#8217;adh\u00e9sion dans les \u00c9tats membres de l&#8217;UE et les candidats.<\/p>\n<p>Les trois points ci-dessus ne pr\u00e9sentent que quelques-unes des questions cl\u00e9s qui sont importantes pour les pays candidats compte tenu de la nouvelle approche de gestion du processus d&#8217;adh\u00e9sion. Ces points, \u00e0 l&#8217;exception de l&#8217;importance nominale de l&#8217;\u00e9tat de droit, ne figurent malheureusement pas en bonne place dans les propositions r\u00e9centes \u00e9manant des \u00c9tats membres sur ce sujet.
