Por, ky trup e bllokoi procesin e miratimit t\u00eb ligjit. Nd\u00ebrkoh\u00eb, Kuvendi votoi ligje me dispozita p\u00ebr mos-diskriminim t\u00eb cilat i p\u00ebrmbajn\u00eb bazat p\u00ebr diskriminim \u2013 orientim seksual dhe identitet gjinor, t\u00eb cilat ishin t\u00eb sh\u00ebnuara\u00a0<a href=\"http:\/\/mhc.org.mk\/announcements\/892?locale=mk&amp;fbclid=IwAR1KJT08AmuwzgBDCU34Iku_zBaEjVpmHBYrVxvqPnFvxYYbLhm9MqL653E#.XIOhIS2ZO-p\" target=\"_blank\" rel=\"noopener\">si \u201ckontestuese\u201d<\/a>\u00a0dhe si shkas p\u00ebr bllokimin e Propozim-ligjit (shih ndryshime dhe plot\u00ebsime t\u00eb \u2013\u00a0<a href=\"http:\/\/www.slvesnik.com.mk\/Issues\/b089570baccc436a9b39c585dca78b3f.pdf\" target=\"_blank\" rel=\"noopener\">Kodit penal<\/a>\u00a0dhe t\u00eb\u00a0<a href=\"http:\/\/www.slvesnik.com.mk\/Issues\/b089570baccc436a9b39c585dca78b3f.pdf\" target=\"_blank\" rel=\"noopener\">Ligjit p\u00ebr sh\u00ebrbime audio dhe audio-vizuale mediatike<\/a>\u00a0nga dhjetori i vitit 2018). \u00a0N\u00eb m\u00ebnyr\u00eb shtes\u00eb, k\u00ebto baza tanim\u00eb jan\u00eb pjes\u00eb e dispozitave jo-diskriminuese n\u00eb dhjet\u00eb ligje t\u00eb cilat jan\u00eb n\u00eb fuqi n\u00eb vendin ton\u00eb, disa prej tyre edhe m\u00eb tep\u00ebr se dhjet\u00eb vjet (p\u00ebr shembull, Ligji p\u00ebr marr\u00ebdh\u00ebnie pune i cili ka dispozit\u00eb t\u00eb till\u00eb, \u00ebsht\u00eb i miratuar n\u00eb vitin 2005). Me k\u00ebt\u00eb, bllokimi i ligjit nuk mund t\u00eb shpjegohet ndryshe p\u00ebrve\u00e7 se si p\u00ebrpjekje p\u00ebr\u00a0<a href=\"https:\/\/prizma.mk\/od-kampovi-za-migranti-do-roditel-1-i-2-kratka-istorija-na-masovni-histerii\/?fbclid=IwAR0oe4WmQ3fa8l8Gs_p_2LCSv1VeC6siM-Hk57CQ0XLXWYftx1veLlTl5ys\" target=\"_blank\" rel=\"noopener\">krijim t\u00eb histeris\u00eb masive<\/a>\u00a0\u00a0me q\u00ebllim t\u00eb marrjes se pikave politike. N\u00eb fund t\u00eb fundit, Ministria e pun\u00ebs dhe politik\u00ebs sociale tanim\u00eb\u00a0<a href=\"http:\/\/www.mtsp.gov.mk\/pocetna-ns_article-vmro-dpmne-manipulira-so-javnosta-bracnata-zaednica-i-terminite-majka-i-tatko-ne-se-menuvaat.nspx\" target=\"_blank\" rel=\"noopener\">reagoi<\/a>\u00a0p\u00ebr k\u00ebt\u00eb dhe sqaroi se Propozim-ligji nuk \u00ebsht\u00eb dhe nuk mund t\u00eb jet\u00eb ligj me t\u00eb cilin do t\u00eb ndryshoj\u00eb materia e cila \u00ebsht\u00eb specialitet e ligjit tjet\u00ebr \u2013 n\u00eb k\u00ebt\u00eb rast d\u00ebshirohet t\u00eb promovohet se ky \u00ebsht\u00eb Ligji p\u00ebr familjen.<\/p>\n<p>P\u00ebr shkak t\u00eb bllokad\u00ebs s\u00eb ligjit,\u00a0<a href=\"http:\/\/www.merc.org.mk\/aktivnost\/57\/gragjanskite-organizacii-baraat-itno-donesuvanje-na-predlog-zakonot-za-sprechuvanje-i-zashtita-od-diskriminacija\" target=\"_blank\" rel=\"noopener\">shtat\u00eb rrjete t\u00eb organizatave joqeveritare dhe nj\u00ebqind organizata joqeveritare ftuan<\/a>\u00a0p\u00ebr miratim urgjent t\u00eb Propozim-ligjit. Pas k\u00ebsaj, Qeveria dha propozim p\u00ebr miratim t\u00eb ligjit me procedur\u00eb t\u00eb shkurtuar, nd\u00ebrsa ligji fitoi edhe flamur evropian. Me k\u00ebt\u00eb,\u00a0<a href=\"https:\/\/www.sobranie.mk\/content\/Delovnik%20na%20RM\/DelovniknaSRMPrecistentekstAvgust13.pdf\" target=\"_blank\" rel=\"noopener\">sipas Rregullores s\u00eb Kuvendit<\/a>, ligji duhej ta kaloj\u00eb procedur\u00ebn n\u00eb Kuvend p\u00ebr dy dit\u00eb. Por, n\u00eb seanc\u00ebn m\u00eb 7-t\u00eb mars, ligji s\u00ebrish nuk u votua. M\u00eb 8 mars, n\u00eb\u00a0<a href=\"https:\/\/www.alsat-m.tv\/mk\/%D0%B0%D0%BA%D1%82%D0%B8%D0%B2%D0%B8%D1%81%D1%82%D0%B8-%D0%B4%D1%80%D0%B6%D0%B0%D0%B2%D0%B0%D1%82%D0%B0-%D1%81%D0%B0%D0%BC%D0%BE-%D0%B4%D0%B5%D0%BA%D0%BB%D0%B0%D1%80%D0%B0%D1%82%D0%B8%D0%B2%D0%BD\/\" target=\"_blank\" rel=\"noopener\">Marshi p\u00ebr t\u00eb drejtat e njeriut<\/a>, aktivistet dhe aktivist\u00ebt thirr\u00ebn p\u00ebr miratim urgjent t\u00eb k\u00ebtij ligji. Gjithashtu \u00ebsht\u00eb paralajm\u00ebruar edhe protest\u00eb p\u00ebr t\u00eb h\u00ebn\u00ebn (11 mars) n\u00eb or\u00ebn 10 para Kuvendit.<\/p>\n<h5>Kush e hartoi propozimin e Ligjit t\u00eb ri p\u00ebr parandalim dhe mbrojtje nga diskriminimi?<\/h5>\n<p>Ligji e p\u00ebrpunoi grupi i posa\u00e7\u00ebm punues i formuar nga Ministria e pun\u00ebs dhe politik\u00ebs sociale n\u00eb vitin 2016. N\u00eb grupin mor\u00ebn pjes\u00eb p\u00ebrfaq\u00ebsues nga ministrit\u00eb kompetente, institucionet komb\u00ebtare p\u00ebr t\u00eb drejtat e njeriut (Avokati i popullit dhe Komisionit p\u00ebr mbrojtje nga diskriminimi), organizatat joqeveritare t\u00eb cilat punojn\u00eb n\u00eb k\u00ebt\u00eb materie p\u00ebrmes dh\u00ebnies s\u00eb ndihm\u00ebs juridike dhe organizatat nd\u00ebrkomb\u00ebtare (OSBE dhe OKB). Propozimi i vler\u00ebsua pozitivisht nga t\u00eb gjitha organizatat nd\u00ebrkomb\u00ebtare dhe rajonale t\u00eb r\u00ebnd\u00ebsishme p\u00ebr vendin ton\u00eb \u2013\u00a0<a href=\"https:\/\/www.venice.coe.int\/webforms\/documents\/default.aspx?pdffile=CDL-AD(2018)001-e\" target=\"_blank\" rel=\"noopener\">Komisioni i Venecias<\/a>\u00a0(K\u00ebshilli i Evrop\u00ebs),\u00a0<a href=\"https:\/\/www.osce.org\/odihr\/374704?download=true\" target=\"_blank\" rel=\"noopener\">Zyra p\u00ebr institucione demokratike dhe t\u00eb drejtat e njeriut &#8211; ODIHR<\/a>\u00a0(OSBE),\u00a0<a href=\"http:\/\/myla.org.mk\/wp-content\/uploads\/2018\/12\/%D0%9C%D0%97%D0%9C%D0%9F-%D0%9F%D0%92%D0%A0-%D0%905-final-PRINT-2.pdf\" target=\"_blank\" rel=\"noopener\">delegacioni i Unionit Evropian<\/a>\u00a0dhe\u00a0<a href=\"http:\/\/myla.org.mk\/wp-content\/uploads\/2018\/12\/%D0%9C%D0%97%D0%9C%D0%9F-%D0%9F%D0%92%D0%A0-%D0%905-final-PRINT-2.pdf\" target=\"_blank\" rel=\"noopener\">Zyra e Komisariatit t\u00eb lart\u00eb p\u00ebr t\u00eb drejtat e njeriut e OKB<\/a>\u00a0(OKB).<\/p>\n<p>Grupi i pun\u00ebs n\u00eb vitin 2016 filloi me pun\u00eb me intenc\u00eb q\u00eb t\u00eb p\u00ebrgatit ndryshime t\u00eb ligjit aktual. Nevoja p\u00ebr ndryshime buronte nga aspirata e vendit ton\u00eb q\u00eb t\u00eb b\u00ebhet an\u00ebtare e Unionit Evropian, si dhe p\u00ebr shkak t\u00eb problemeve me zbatimin e ligjit t\u00eb vjet\u00ebr n\u00eb praktik\u00eb. Por, u tregua se mbi nj\u00eb e treta e neneve n\u00eb ligjin ekzistues do t\u00eb duhet t\u00eb p\u00ebsojn\u00eb ndryshime. Sipas \u00a0<a href=\"https:\/\/www.legislationline.org\/documents\/id\/15456\" target=\"_blank\" rel=\"noopener\">dispozitave tona<\/a>, kur mbi nj\u00eb e treta nga nenet n\u00eb nj\u00eb ligj duhet t\u00eb jan\u00eb subjekt i ndryshimeve dhe t\u00eb plot\u00ebsimeve, nuk mund t\u00eb punohet n\u00eb ndryshime dhe plot\u00ebsime por patjet\u00ebr duhet t\u00eb punohet n\u00eb miratimin e tekstit t\u00eb ri ligjor. Dhe, k\u00ebshtu grupi i pun\u00ebs filloi t\u00eb punoj\u00eb n\u00eb tekstin p\u00ebr Ligj t\u00eb ri p\u00ebr parandalim dhe mbrojtje nga diskriminimi.<\/p>\n<h5>P\u00ebrse ka nevoj\u00eb p\u00ebr ndryshim t\u00eb ligjit ekzistues?<\/h5>\n<p>Aderimi n\u00eb UE \u00ebsht\u00eb baz\u00eb e harmonizimit t\u00eb legjislativit komb\u00ebtar me t\u00eb drejt\u00ebn e Unionit Evropian. N\u00eb m\u00ebnyr\u00eb shtes\u00eb, n\u00eb qershor t\u00eb vitit 2018 Komisioni Evropian miratoi\u00a0<a href=\"https:\/\/ec.europa.eu\/info\/sites\/info\/files\/2_en_act_part1_v4.pdf\" target=\"_blank\" rel=\"noopener\">rekomandim n\u00eb lidhje me trupat p\u00ebr barazi<\/a>\u00a0i cili, edhepse nuk \u00ebsht\u00eb direktiv\u00eb, me siguri do t\u00eb jet\u00eb standardi i cili do t\u00eb shfryt\u00ebzohet p\u00ebr harmonizimin e vendosm\u00ebris\u00eb (p\u00ebrfshir\u00eb edhe pavar\u00ebsin\u00eb, efektivitetin dhe potencialit p\u00ebr bashk\u00ebpunim) dhe t\u00eb kompetencave t\u00eb trupave p\u00ebr barazi t\u00eb vendeve-kandidate, si\u00e7 rasti me vendin ton\u00eb dhe Komisioni p\u00ebr mbrojtje nga diskriminimi).<\/p>\n<p>Ligji i ri miratohet p\u00ebr harmonizimin me k\u00ebto standarde dhe, para s\u00eb gjithash, me direktivat p\u00ebr barazi. T\u00eb gjitha k\u00ebto direktiva p\u00ebrcaktojn\u00eb vet\u00ebm\u00a0<em>standarde minimale<\/em>\u00a0t\u00eb cilat \u00e7do vend an\u00ebtar duhet ti p\u00ebrmbush\u00eb. Me k\u00ebt\u00eb rast, ato l\u00ebn\u00eb hap\u00ebsir\u00eb p\u00ebr rregullimin deri n\u00eb fund t\u00eb materies n\u00eb nivel t\u00eb vendit sipas traditave dhe specifikave vendore t\u00eb sistemeve juridike dhe politike t\u00eb vendeve an\u00ebtare.<\/p>\n<p>Miratimi i ligjit korniz\u00eb p\u00ebr mbrojtje nga diskriminimi p\u00ebr her\u00eb t\u00eb par\u00eb u vendos si kusht\/p\u00ebrcaktues i dh\u00ebn\u00eb nga UE n\u00eb kontekst t\u00eb\u00a0<a href=\"https:\/\/www.esiweb.org\/pdf\/White%20List%20Project%20Paper%20-%20Roadmap%20Macedonia.pdf\" target=\"_blank\" rel=\"noopener\">liberalizimit t\u00eb regjimit t\u00eb vizave n\u00eb vitin 2008<\/a>. Ligji i miratuar n\u00eb vitin 2010 pa marr\u00eb parasysh se n\u00eb nj\u00eb mas\u00eb t\u00eb caktuar i p\u00ebrmbush standardet minimale, u kritikua p\u00ebr shkak t\u00eb disa mang\u00ebsive thelb\u00ebsore. Analiza t\u00eb plot\u00eb t\u00eb korniz\u00ebs ligjore, dob\u00ebsit\u00eb dhe mang\u00ebsit\u00eb e saj, ka n\u00eb\u00a0<a href=\"https:\/\/www.dropbox.com\/s\/7688zae60e6nluj\/Harmonization%20Analysis_Final_MK.pdf?dl=0\" target=\"_blank\" rel=\"noopener\">Analiz\u00ebn e harmonizimit t\u00eb legjislativit vendor p\u00ebr barazi dhe mos-diskriminim<\/a>\u00a0i hartuar p\u00ebr OSBE dhe KMD (Komisioni p\u00ebr mbrojtje nga diskriminimi) n\u00eb vitin 2015. Si ky\u00e7 theksohen tre mang\u00ebsi \u2013 p\u00ebrfshirja personale, vendosm\u00ebria institucionale dhe p\u00ebrshtatjet procedurale.<\/p>\n<p>P\u00ebrfshirja personale e ligjit p\u00ebrcakton se cilat persona do t\u00eb p\u00ebrfshihen me mbrojtjen e ligjit.\u00a0<a href=\"http:\/\/www.pravo.org.mk\/documentDetail.php?id=4846\" target=\"_blank\" rel=\"noopener\">Ligji i tanish\u00ebm<\/a>\u00a0nuk e mbulonte t\u00ebr\u00ebsisht\u00a0<a href=\"https:\/\/www.equalitylaw.eu\/downloads\/4758-fyr-macedonia-country-report-non-discrimination-2018-pdf-2-66-mb\" target=\"_blank\" rel=\"noopener\">p\u00ebrfshirjen minimale personale t\u00eb parapar\u00eb me legjislativin e UE<\/a>. Kjo ishte e theksuar n\u00eb t\u00eb gjitha\u00a0<a href=\"https:\/\/ec.europa.eu\/neighbourhood-enlargement\/countries\/detailed-country-information\/north-macedonia_en\" target=\"_blank\" rel=\"noopener\">raportet p\u00ebr avancimin e vendit ton\u00eb<\/a>, q\u00eb nga viti \u00a02011 deri m\u00eb sot, t\u00eb cilat i p\u00ebrpilon Komisioni Evropian. P\u00ebr shembull, n\u00eb ligjin e tanish\u00ebm, p\u00ebrfshirja e personave me pengesa \u00ebsht\u00eb m\u00eb i ngusht\u00eb se sa ai i parapar\u00eb me legjislativin e UE dhe i p\u00ebrfshin vet\u00ebm pengesat \u201cmendore\u201d dhe fizike. \u00a0Bindja si baz\u00eb p\u00ebr diskriminim\u00a0 \u00ebsht\u00eb vendosur n\u00eb m\u00ebnyr\u00eb tep\u00ebr t\u00eb ngusht\u00eb dhe \u00ebsht\u00eb e nd\u00ebrlidhur me bindjen fetare. Gjithashtu, aspak nuk \u00ebsht\u00eb parapar\u00eb orientimi seksual si baz\u00eb p\u00ebr diskriminim, edhepse ajo \u00ebsht\u00eb pjes\u00eb e ligjeve t\u00eb tjera t\u00eb cilat kan\u00eb dispozita p\u00ebr mos-diskriminim. P\u00ebr shembull, n\u00eb vitin 2010 u votua Ligji p\u00ebr mos-diskriminim (i cili tani \u00ebsht\u00eb n\u00eb fuqi) dhe i cili nuk e parashikon orientimin seksual si baz\u00eb mbrojt\u00ebse, e nd\u00ebrkaq Ligji p\u00ebr vullnetariz\u00ebm p\u00ebrmban dispozit\u00eb p\u00ebr mos-diskriminim e cila e p\u00ebrmban edhe orientimin seksual (termi q\u00eb p\u00ebrdoret \u00ebsht\u00eb \u201corientimi gjinor\u201d).<\/p>\n<p>Legjislativi i UE k\u00ebrkon caktim t\u00eb trupit ekzistues ose formim t\u00eb trupit t\u00eb ri t\u00eb pavarur p\u00ebr barazi me mund\u00ebsi q\u00eb t\u00eb procedoj\u00eb raste, t\u00eb jap\u00eb k\u00ebshilla dhe t\u00eb grumbulloj\u00eb t\u00eb dh\u00ebna n\u00eb lidhje me mbrojtjen nga diskriminimi. Ligji p\u00ebr mos-diskriminim ka parapar\u00eb formimin e trupit p\u00ebr barazi \u2013 Komision p\u00ebr mbrojtje nga diskriminimi. Por, t\u00eb nj\u00ebjtin e parashikoi pa mund\u00ebsi p\u00ebr formimin e sh\u00ebrbimit t\u00eb tij administrativ. E, k\u00ebshtu, t\u00eb dy p\u00ebrb\u00ebrjet e deritanishme t\u00eb KMD i kryenin vet\u00eb pun\u00ebt administrative, ose me ndihm\u00ebn e vullnetar\u00ebve nga MPPS dhe\/ose t\u00eb siguruar p\u00ebrmes projekteve me sektorin civil. P\u00ebr shkak t\u00eb k\u00ebsaj, kalimi nga nj\u00ebra n\u00eb p\u00ebrb\u00ebrjen tjet\u00ebr t\u00eb KMD rezultonte me humbje t\u00eb konsiderueshme t\u00eb memories institucionale dhe kapacitetin e trupit i cili u nd\u00ebrtua gjat\u00eb mandatit t\u00eb par\u00eb. Mandej, sipas ligjit, p\u00ebr an\u00ebtar t\u00eb KMD mund t\u00eb zgjedhej \u00e7dokush q\u00eb ka kryer arsim sip\u00ebror n\u00eb fush\u00ebn e shkencave shoq\u00ebrore dhe pes\u00eb vjet p\u00ebrvoj\u00eb pune. Kjo do t\u00eb thoshte se, p\u00ebr shembull, person me fakultet t\u00eb kryer t\u00eb ekonomis\u00eb q\u00eb ka punuar n\u00eb bank\u00eb pes\u00eb vjet, formalisht do ti p\u00ebrmbush kushtet p\u00ebr an\u00ebtar t\u00eb KMD. Nuk ekzistonte kurrfar\u00eb kriteri formal me t\u00eb cilin do t\u00eb k\u00ebrkohej ekspertiz\u00eb n\u00eb fush\u00ebn konkrete \u2013 barazi dhe mos-diskriminim. K\u00ebshtu, me p\u00ebrjashtime t\u00eb pakta, an\u00ebtar\u00eb t\u00eb KMD jan\u00eb persona me\u00a0<a href=\"https:\/\/www.equalitylaw.eu\/downloads\/3752-macedonia-appointment-of-new-members-of-the-equality-body-pdf-123-kb\" target=\"_blank\" rel=\"noopener\">pavar\u00ebsi problematike<\/a>\u00a0ose t\u00eb cil\u00ebt\u00a0<a href=\"http:\/\/kvadraturanakrugot.crnaovca.mk\/2010\/12\/26\/predlog-za-chlenovi-na-komisijata-za-zashtita-od-diskriminacija\/\" target=\"_blank\" rel=\"noopener\">nuk jan\u00eb ekspert\u00eb<\/a>\u00a0n\u00eb\u00a0<a href=\"http:\/\/studiorum.org.mk\/en\/wp-content\/uploads\/2013\/03\/NHRI_Study_MKD-2012for_web.pdf\" target=\"_blank\" rel=\"noopener\">fush\u00ebn<\/a>\u00a0n\u00eb t\u00eb cil\u00ebn jan\u00eb caktuar q\u00eb t\u00eb punojn\u00eb.<\/p>\n<p>N\u00eb raport me p\u00ebrshtatjet procedurale me legjislativin e UE parashihet standard p\u00ebr transferimin e barr\u00ebs s\u00eb prov\u00ebs. Sipas k\u00ebtij standardi, personi q\u00eb pohon se \u00ebsht\u00eb i diskriminuar, duhet t\u00eb paraqes\u00eb vet\u00ebm\u00a0<em>fakte<\/em>\u00a0nga t\u00eb cilat mund t\u00eb\u00a0<em>supozohet<\/em>\u00a0diskriminimi. Ky standard \u00ebsht\u00eb i vendosur n\u00eb shkall\u00eb kaq t\u00eb ul\u00ebt sepse diskriminimi konsiderohet si vep\u00ebr e cila mund t\u00eb d\u00ebshmohet shum\u00eb v\u00ebshtir\u00eb. N\u00eb m\u00ebnyr\u00eb shtes\u00eb, provat m\u00eb shpesh jan\u00eb n\u00eb duart e diskriminuesit potencial. \u00a0Por, ligji yn\u00eb, q\u00eb tani \u00ebsht\u00eb n\u00eb fuqi, v\u00eb barr\u00eb tejet t\u00eb madhe t\u00eb d\u00ebshmimin\u00a0 n\u00eb personat t\u00eb cil\u00ebt pohojn\u00eb se jan\u00eb t\u00eb diskriminuar dhe, n\u00eb kund\u00ebrshtim me t\u00eb drejt\u00ebn evropiane, k\u00ebrkon t\u00eb paraqesin\u00a0<em>edhe fakte edhe prova\u00a0<\/em>t\u00eb cilat e \u00a0<em>arsyetojn\u00eb\u00a0\u00a0<\/em>pohimin e tyre. Me vet\u00eb at\u00eb, n\u00eb t\u00eb drejt\u00ebn e vendit ton\u00eb p\u00ebr momentin mungon nj\u00eb nga p\u00ebrshtatjet kryesore procedurale t\u00eb cilat u jan\u00eb t\u00eb nevojshme personave t\u00eb cilat konsiderojn\u00eb se jan\u00eb t\u00eb diskriminuar me q\u00ebllim q\u00eb t\u00eb ken\u00eb ndonj\u00eb lloj gjas\u00eb q\u00eb rasti i tyre t\u00eb shqyrtohet n\u00eb m\u00ebnyr\u00eb p\u00ebrkat\u00ebse.<\/p>\n<p>Krahas k\u00ebtyre harmonizimeve, ligji u tregua si i v\u00ebshtir\u00eb p\u00ebr zbatim edhe para gjykatave.\u00a0 Ligji duhej t\u00eb mund\u00ebsonte procesuim t\u00eb rasteve t\u00eb diskriminimit nga gjykatat. Por, rrall\u00eb kush mund ti lejoj\u00eb vetes q\u00eb t\u00eb inicioj\u00eb raste t\u00eb k\u00ebtilla para gjykat\u00ebs p\u00ebr shkak t\u00eb shpenzimeve q\u00eb lidhen me k\u00ebto procedura. P\u00ebr shembull, person q\u00eb posa e ka humbur vendin e pun\u00ebs p\u00ebr shkak t\u00eb p\u00ebrkat\u00ebsis\u00eb s\u00eb vet etnike nuk ka t\u00eb ardhura stabile mujore p\u00ebr t\u00eb mund t\u00eb inicioj\u00eb nj\u00eb rast t\u00eb till\u00eb. P\u00ebr ata t\u00eb cil\u00ebt, prap\u00ebseprap\u00eb, nuk d\u00ebshirojn\u00eb t\u00eb shkojn\u00eb p\u00ebrmes gjykatave dhe parap\u00eblqejn\u00eb q\u00eb rastin ta zgjidhin p\u00ebrmes institucionit tjet\u00ebr, ligji q\u00eb tani \u00ebsht\u00eb n\u00eb fuqi duhej ta ofronte Komisioni p\u00ebr mbrojtje nga diskriminimi. Por, p\u00ebr shkak t\u00eb shkaqeve t\u00eb v\u00ebna n\u00eb pah m\u00eb lart\u00eb, si dhe p\u00ebr shkaqe t\u00eb tjera (p\u00ebr shembull, var\u00ebsia financiare) ky trup kurr\u00eb nuk u jet\u00ebsua si trup i pavarur i cili do t\u00eb q\u00ebndroj\u00eb n\u00eb mbrojtje t\u00eb parimit t\u00eb barazis\u00eb n\u00eb shtetin ton\u00eb.<\/p>\n<h5>Si ligji i ri do ti zgjidh k\u00ebto probleme?<\/h5>\n<p>Me propozim-ligjin, t\u00ebr\u00ebsisht m\u00ebnjanohen t\u00eb gjitha mungesat e theksuara dhe aplikohen rregulla n\u00eb baz\u00eb t\u00eb \u201cleksioneve t\u00eb m\u00ebsuara\u201d. Zgjerohet p\u00ebrfshirja personale, me \u00e7ka m\u00eb tep\u00ebr persona do t\u00eb mund ta shfryt\u00ebzojn\u00eb mbrojtjen nga diskriminimi. Sqarohet p\u00ebrfshirja materiale me \u00e7ka b\u00ebhet m\u00eb e qart\u00eb se cili trajtim \u00ebsht\u00eb i pa arsyesh\u00ebm. Parashikohet heqje e taksave gjyq\u00ebsore p\u00ebr k\u00ebto raste me \u00e7ka do t\u00eb shtohet qasja n\u00eb gjykatat. Sakt\u00ebsohen deri n\u00eb fund kriteret p\u00ebr zgjedhje t\u00eb an\u00ebtar\u00ebve t\u00eb trupit p\u00ebr barazi me \u00e7ka zvog\u00eblohet mund\u00ebsia p\u00ebr hyrje t\u00eb an\u00ebtar\u00ebve q\u00eb nuk kan\u00eb ekspertiz\u00eb. Sakt\u00ebsohen kushtet p\u00ebr shkarkim t\u00eb an\u00ebtar\u00ebve.\u00a0 Komisioni fiton edhe kompetenca t\u00eb zgjeruara dhe do t\u00eb veproj\u00eb si Komision p\u00ebr parandalim dhe mbrojtje nga diskriminimi. Fuqizohet t\u00ebr\u00ebsisht pavar\u00ebsia e trupit, p\u00ebrfshir\u00eb edhe pavar\u00ebsin\u00eb financiare, me dispozit\u00eb t\u00eb ngjashme me at\u00eb q\u00eb tanim\u00eb vlente p\u00ebr Avokatin e popullit. N\u00eb m\u00ebnyr\u00eb shtes\u00eb, me ligjin parashihen edhe dispozita, si p\u00ebr shembull ndasia si\u00a0 form\u00eb e ve\u00e7ant\u00eb e diskriminimit ose mbrojtja e diskriminimit intern-seksionesh, me \u00e7ka do t\u00eb kapet hapi me rrjedhat bashk\u00ebkohore dhe do t\u00eb ofroj\u00eb baz\u00eb solide ligjore p\u00ebr parandalim dhe mbrojtje nga diskriminimi n\u00eb nj\u00eb periudh\u00eb t\u00eb af\u00ebrt n\u00eb t\u00eb ardhmen.
